The Magistrate stated there was no evidence of criminal negligence to warrant ac- lcused being committed to Supreme ycourt, on a charge either of niaii- slaughter or reckless driving. The hearing, which was opened on July sum, arose as a result of the death of Robert Clark Bry- enton, following a car accident on July 5th. near Fairvieiv. deceased was in company Notting, who was driving. Cpl. Allan Johnswne, of the R. C. M. P,. in his evidence, sub- mitted photograplis of the scene of the accident, and was followed by Cons. Thurston, who gave dc- taiis of the investigation, includ- ing measureiiieiiis at the scene of the accident. From where the car began to slew iii the road until it came to rest in a field, after break- ing down posts and a fence, was a. distance of 300 feet. Cpl. It was con-l sidered dangerous by himself and, others in the vicinity. 4 I John Notting testified on ma own behalf that he was on his way to Holland Cove in company lwith Bryenton, intending to re- willi turn to the city to attend the lraces. He had been over the road lance before, but had not been driving the car at that time. The occasion of te accident was the first time he ad driven 3 car over lit, and he was not familiar with it. ,He testined that he had not been :drinking either during the after- llioon or evening. I He had purchased the car in fNova Scotia about two weeks "previously and had made minor repairs himself, and believed it to be in good working order. He was driving at -10 or 45 miles per hour and did not realize that hel was approachim: a turn. Ther were no signs to this effect. H felt a pull to the right and almost instantly went into the ditch, be-; coming unconscious. He had only a vague impression of what hap-l peiied afterwaids. Mr. John P.
