WHEREAS a Commision, bearing date the 6th day ofJuly instant, has been issued to us under and by virtue of an Act passed in the 14th year of the reign ofHer present Majesty Queen Victoria, intituled “ an Act to regulate the laying out and altering of Highways,” and the Act in amendment thereof, whereby we are commanded to estimate the damage or advan- tage that may accrue to those persons who are interested in the land through which a certain new Road is intended to pass, leading from the Saint Peter’s Road, as run off by the late Superintendent of Public Works, through Hayden’s or Longworth’s Shipyard, to the site of the new Wharf, on the north side of the Hillsborough, opposite Fisher‘s Wharf: Now we do hereby give Public Notice to all persons concerned that we will commence the execntion of the said Commission, by attending at the house of Alexander Hayden, in Township number Thirty-six, on Monday, the 16th day of September next, at the hour of ten o‘clock in the forenoon of the said day, and proceed along the said intended newline of Road, and complete the said Commission according to law. N the matter ofan application for execution to be issued against the lands of ELISHA HOOPER, late of Bedeque, Township Number Twenty-six, in Prince County, in Prince Edward Island, Farmer, deceased, all his right, title and interest therein, under the provisions of the Act of the General _Assembly of the said Island, passed in the 'I‘wenty-fourth year of the Reign of Her Majesty Queen Victoria, entitled “ An Act in amendment of and addition to the Act relating tojudgment entered of reCord in the Supreme Court of Judicature,” upon a certainjudginent entered of Record in the said Court, in a cause wherein Ralph Brecken was Plaintiff, and the said Elisha Hooper and Lemuel Hooper were Defendants. Whereas application has been made to this Court, on the part of the above named Plaintiff Ralph Brecken, stating that the sum of Ollejhlll'ldl‘ed and six pounds four shillings is due to him on and secured by a certain Judgment of Record, at his suit against the said Elisha Hooper and one Lcinuel Hooper, on or about Easter Term, A. D. 1852, for the sum of Two hundred pounds debt, and the sum of’I‘liree pounds cost of suits, and execution on such judgment has been moved for on behalf of the said Ralph Brecken : It is ordered that unless all or some of the persons interested in the Lands, formerly belonging to the said Elisha Hooper, deceased, shall on the first day of October next coming, at Saint Eleanor's, come forward and shew cause why Execution should not be issued upon the aforesaid judgment against the Lands of the said Elisha Hooper, deceased, or his former right, title and interest therein, then execution will be issued against the Lands, tenements, and hereditaments of said Elisha Hooper, deceased, in the pursuance of the Act of the General Assembly of Prince Edward Island, passed in the ’I‘wenty-fourth year of the Reign of Her present Majesty, intituled “ An Act in amendment of and in addition to the Act relating to Judgment entered of Record in the Supreme Court of Judicature.” On Affidavit of Ralph Brecken, and on motion of Mr. Hodgson, of Counsel for the Plaintiff. Hunt, in and to a. quarter of an acre of Land, with the buildings and improvements thereon, situate in St. Eleanor‘s, Lot or Townihip No. 17. in Prince County; and I do hereby give Public Notice, that I will, on the 12th day of September, 1867, at 12 o’clock, noon, at the Court [loose in St. Eleanor’s. in the said County, set up and sell at Public Auction, the said property, or as much thereof as will satisfy the levy marked on the said writ, being £53 currency, with lawful interest on the sum of £50, part thereof, from the 11th June. 1861, until paid, and 178, for said writ, besides Sherifi’s fees and incidental expenses.
