Mr. pMacDonaid. retired recently on pension from the position of chief purscr of the Abegwelt. - ENGAGEMENT O Mr. and Austin Smith. who said he as- caped from Bummerside Jail with a desire to go out and have A good time after; he had consumed half a. pint of moonshine and half B gallon of beer, and l-Iarvle Mercier. who, among other privileges, was entrusted to make evening tea for. the inmates. and who violated his privileges. and also escaped cust- ody. were each sentenced to an ad- ditional six months in jall' alter hearings in court before Magistrate R.S. Hinton, Q. 0., in Summerside yesterday. Smith. who was serving 15 days for being intoxicated in a public place, escaped- on the evening of August lith and returned volun- tarily five days later. Jallor Harry Bishop testified that Smith had been in Jail when he went off duty about 6 o'clock, and that about 9 P. M. he had received a report that the prisoner was mim- ling. He said he returned to the jail and discovered a padlock on 11 door had been broken. The accused. speaking in his own defence. said he had not broken the padlock but had found it hanging unlocked on the stapie. He said his escape had been made through a window which was clos- ed but unlocked. The accused said a full pint or moonshine and a full gallon of home-made beer had been brou ht in from the jails kitchen. and he and a fellow prisoner had con- sumed it all in about equal quan- titles. ltold by a. tihirri prisoner that these beverages were in the jails kitchen but did not know how they got there. He said that he had not paid any money for either the moonshine or the beer. and that after all the supply had been consumed he de- cided to go out of jail and hove a good time. Ho said he had been scared to returr!to jail when he sobered up the next day. out had returned voluntarily on the night of the 5th day after he escaped. At the conclusion of the hearing the Magistrate said he did not be- have much of the story told by the accused, and warned that strict penalties, will have to be imposed if further attempts at jail break occur. Mercier, the second prisoner charged with Jail break. had been sentenced on August 13th to one month for theft and was serving this sentence when he disappeared from Jail about 8.30 on the night oi August 24th. He was re-arrested in Sydney Mines on August 27th. Victor Allen, the assistant jailer. said that he had gone upstairs to the jailor's apartment to discuss the request of a prisoner who wanted to get out on bail. He said that Mercier had been given the privilege of moving around at will within the Jail, and when he came down stairs he discovered that Mercier had disappeared. Two other cases were before the court - a man arrested near Wel- lington Center for being intoxicat- ed in a public place was fined szii and costs.
