This is an appeal from the deci- sion of the Judge of the County Court oi‘ Queen’s County in an ill- terpleader granted on application of the ‘Sheriff of Queen's County in the following circumstances: Montgomery the appellant above named had recovered judgment in the said County Court against Ells- worth Diamond the defendant in the action for damages resulting from a collision between. an auto- aobile driven hyuthegtleiendant I d an automobile or the appel- lant.
