The Cases of Irving and Calvin Lewis Before

mitted with Reference to Escape and Shooting.
Before his lordship Mr Justice Has-
zard on Friday morning in the
Supreme Court. Summerside, Calvin
Lewis and 'Irving Lewis were placed
in the dock on an indictment charging
them with having on the 20th March
1915, broken out of the jail at Alber-
ton, where they were confined in law-
ful custody. This is the first of a
series of cases in which one or the
other of the Lewises will be charged
indictably. Much interest is being
taken in the present case slid wl1e11 it
was called on Friday the Court House
was filled.
The Attorney-General. Hon. J. A.
Mathieson, assisted by Mr J. E. Wyatt,
conducted the prosecution. while the
accused. who pleaded not guilty. were
represented by Mr J. J. Johnson. K.C.
Considerable evidence was given on
behalf of the crown. and at adjourn-
ment of the Court st 5.30 p.m., Joseph
Brown. police constable at Alberton,
and one of the principal witnesses
for the prosecution. was put on the
stand. The case was resumed on
Saturday morning at 10 o'clock,
Brown again taking the stand under
cross~examination.
At 3.45 p.m. the Attorney-General
announced the case for the crown
closed. whereupon Mr Johnson, on
behalf of thefsccused. moved to have
the case withdrawn from the jury and
the prisoners discharged, on the
ground that no evidence had been
adduced by the prosecution to sub-
stantiate the charge. I-ie made a
lengthy address to the Collrt, quoting
several authorities and basing his
argument principally on the conten-
tion that the prosecution had not pro-
duced any evidence to show that the
place in which the prisoners had been
locked up after their arrest was the
lawful jail of Alberton, and recognised
as such by the mllniciptal authorities
of that town.
His Iordship overruled this objec-
tion and informed counsel that he had
decided to submit the case to the jury.
Mr Johnson accordingly opened the
case for the defence, addressing the
jury for half-an-hour. and at 5 o'clock
the Court adjourned.

engineer. in the employ of the Pro-
vincial Government, was the first
witness examined for the prosecution
Friday morning, ai1d.he produced a
plan made by him on June 7, showing
the location of the premises of P. B.
Lewis, Irving Lewis. certain buildings
in the neighbourhood and the dwel-
ling-liouse of Mr William Hogan, on
the door of which it was stated ill
evidence shots were found embedded
in the woodwork.
Mr George H. Barbour, Prosecutor
of Alberton, gave evidence, beillg oil
the stand for upwards of four hours.
Ile snid that Ile put Calvin Lewis into
the lock-up between six and seven
_o'clock on the evening in question,
having arrested him for a second
offence under the Prohibition Act.
He then went on to tell of a search
made by him ami Constable Brown for
liquor in the vicinity of P. B. Lcwls's
premises, where they found a basket
containing bottles of liquor. Willie
thus engaged they heard two reports
of n gun fired in quick succession and
felt a current of air ns the shots
passed near them. They removed the
liquor and subsequently traced tracks
made by two persons in the snow
right up to Irving Lowis’s home.
There had been a recent snowfall und
the tracks were quite visible. They
obtained the boots Archie and
Irving had been wearing and.
placing tllcm on the foot-prints
in illc snow. the boots fitted
exactly in thc impressions. On this
they srresiod Arcllie mill Irving Lewis
and took them to the jail, placing
them ill tI1e ccll witll Calvin, wllo had
been apprehended earlier ill the even-
ing. Witness and Brown afterwards
obtained the gun, which they identi-
ilcd in Court, and into which two dis-
charged cartridges which were found
on the scene of the shooting fitted.
Evidence further showed tilat Calvin
Lewis and Irving Lewis later ill the
night effected their escape fronl jail,
witnesses Barbour and Brown testi-
fying to illldilig the lock-up broken.
Brown corroborated Barbour in all
particulars. He also was on the stand
a considerable time, being subjected
to a lengthy cross-examination.
