Before his lordship Mr Justice Has- zard on Friday morning in the Supreme Court. Summerside, Calvin Lewis and 'Irving Lewis were placed in the dock on an indictment charging them with having on the 20th March 1915, broken out of the jail at Alber- ton, where they were confined in law- ful custody. This is the first of a series of cases in which one or the other of the Lewises will be charged indictably. Much interest is being taken in the present case slid wl1e11 it was called on Friday the Court House was filled. The Attorney-General. Hon. J. A. Mathieson, assisted by Mr J. E. Wyatt, conducted the prosecution. while the accused. who pleaded not guilty. were represented by Mr J. J. Johnson. K.C. Considerable evidence was given on behalf of the crown. and at adjourn- ment of the Court st 5.30 p.m., Joseph Brown. police constable at Alberton, and one of the principal witnesses for the prosecution. was put on the stand. The case was resumed on Saturday morning at 10 o'clock, Brown again taking the stand under cross~examination. At 3.45 p.m. the Attorney-General announced the case for the crown closed. whereupon Mr Johnson, on behalf of thefsccused. moved to have the case withdrawn from the jury and the prisoners discharged, on the ground that no evidence had been adduced by the prosecution to sub- stantiate the charge. I-ie made a lengthy address to the Collrt, quoting several authorities and basing his argument principally on the conten- tion that the prosecution had not pro- duced any evidence to show that the place in which the prisoners had been locked up after their arrest was the lawful jail of Alberton, and recognised as such by the mllniciptal authorities of that town. His Iordship overruled this objec- tion and informed counsel that he had decided to submit the case to the jury.
