He said the cigarettes were the pro- perty of H. C. For-tier Co., Mon- treal. and asked the jury to try to put from their minds all the evidence they had heard last week First Witness The first witness called by the Crown was Mr. Joseph Legace. sec- retary treasurer of H. C. Fortier Co., who stated his firm were the sole agents for Macdonald'a Tobac- co in New Brunswick, Prince Ed- ward Island and Quebec. and the local firm of .1. C. Montgomery was the only representative in this Province. Under questioning he started to describe the manner in which business was conducted between his firm and Mr. Montgomery. De- fense counsel, Mr. Allison Gillis. objected on the ground that if there were a contract between the two it should be produced. As the questiinlng continued, however. the witness stated that some orders received from here are turned over to Macdonald's for direct handling. some shipped from his flrm's Montreal stock and the rest de- livered from the consignment stock in Mr. Montgomery's warehouse. Regarding the sale of Exports in tins of "flat fifties” he stated there were none shipped here prior to November as they had been in short supply all year. He had a record of all that came here and told the Court which wholesalers had been the consignees. Ho stat- ed that no one else could get Ex- ports as they only shipped to legiti- mate accounts, however under cross examination by Mr. Gillis he was not prepared to say it would be impossible to get Exports from some other company. On objection by Mr. Gdllls to the "hearsay" nature of the re- cords introduced the Court noted the objection. A number of witnesses holding positions as shipping clerks or other posts in wholesale business firms of the Province testified as to the number of Exports their employers has received. All ship- ments of flat fifties were receiv- ed in November for the first time. They included David Murray. R. T. Holman Ltd.; Flt. Sgt. L. H. Kel- sey, R..C.A.F.; Roy Johnson, Rogers and Arnett. all of Siimmei-side; Patrick Read. DeBiois Bros.: Wil- liam Partridge, Atlantic Whole- salers. After Recess After the noon recess Mr. J. C Montgomery was called to the stand. He told of the various busi- ness transactions of his firm and methods of operating. He stated that cigarettes had been stolen from his warehouse and after stock was taken it was learned that 61.- 000 were missing. He had been ab- sent from the Province at the . to stop the car. He also testified he heard no mention of cigarettes. Police Testimony City Police Chief Charles Mae- Arthur told of being in hiding near where the cigarettes had been re- ported as being. He was accom- panied by Sgt. Lund. On the ef- temoon in question he saw a car on the road while they were hid- ing. Later he heard a noise as people came through the woods in the direction of the cigarette cache. He heard one of the men say ”Here they are" and he and Sgt. Lund immediately jumped for them and placed them under ar- rest. He stated they were stopped over as near to the cigarettes as they could get. Detective Sgt. Anthony Lund told of investigating the break and described the conditions of the Montgomery premises. He said the only way to get to the rear when the Queen Street gate is locked is over one of two fences separating the yards from near- by residents. He said he had been with the Chief at all times during the wait in the woods and had personally grabbed the accused. He said they were stooped over the cache when arrested. Sgt. Sterns Webster.
