The Supreme Judicial Court of Maine has just given a judgment in the case of Ayer vs. the Western Union Telegraph Co. which will prove of unusual interest to the commercial public. The circumstances of the case were as follows: Ayer sent a tele- gram from Bangor, Me., to his correspond- ent at Philadelphia, saying: ‘Will sell 800 M. laths, delivered at your whari, two ten net ‘cash. July shipment. Answer quick.” The message was deliverd with the word **ten” omitted, and the reply was sent: ‘* Accept your telegraphic offer on laths. Cannot increase price spruce.” Although the error was, subsequently dis- covered by correspondence, the Philitel- phia merchant insisted on the purchase, and Ayer sued the Western Union Tele- graph Co. to make good his loss. The company put forward in its defence the printed message form coutaining the stipu- Jation that the company should not be held liable unless the message was repeated by by the sender at his own cost. The supreme court over-ruled. the defence, and gave damages to the plaintiff ou the ground that the stipulation as to the non-liability for an unrepeated message is vcid, and that the mistake was the fault of the company’s officia!s. The judgment a ** Telegraph companies are quasi-public servants. They receive from the public valuable franchises; they owe the public care and diligence ; their business intimately concerns the public; many and yarious interesis are practically depeudent upon it; early all intefests may be affected by it, and thus negligence in it may ofteu work wre; arable mischief to individuals and } lso 8S vid .
