Dr. Frank Miacuillan told of be- mg called to the P. E. 1. Hospital :4; attend the 16-year-old Bevan. He said of the injuries received that there were abrasions on the lace and chest, scalp lacerations ma the left clavicle was obviously broken. The victim was in hospital mm days. Dr. Macmillan was called as a witness by Mr. G. F. Foster, attorney for the plaintiff. There was no cross examination by Mr. M. A. Farmer for the defend- t. mitir. H. Bevan, father of the boy, .aid his son was the owner of asun znotorcycle which he had paid for himself. He told of conversations with the defendant who said he was sorry and would do all he -ouid. ' 3 boy had lost out on his earnings from a paper route which iverged 58 per week income. The plaintiff was called to the orcycle since last year. It was in perfect running condition. On the night or the accident he had been travelling west on Grafton Street at approximately 15 miles per hour. .As he was going through the lla- terseotlo I of Prince Stret he look- ed to his left and saws oar ap- proaching. He put on his brakes and tried to avoid the accident but failed as the ear collided with the front fork of his bike. He remem- bered nothing after that as he was nacious. Questioned by Mr. Farmer the witness said he was about one yard from the intersection when he saw the' car. He did not know what part of the car hit him. Murray Carmichael, the next witness, said he was working that night and was looking out a win- dow at the corner and saw the col- lision. He thought the car had slowed down a. bit at the stop sign on Prince St. south of Grafton but kept moving along through the in- tersection. He estimated its speed at about 25 miles. After the acci- dent the car came to a stop in front of Worth's Drugstore. He heard the sound of brakes from the mot- orcycle and saw it hit around the back door of the car. Alfred MaoLeod said he saw the car coming north on Prince Street through the intersection and then come to a stop. He did not see the accident as the car was be- tween him and the bike which he not going fast. Ernest Vail, an automotive me- chanic, said he had examined the bike since the accident and thought it would be impractical to attempt to repair it.eIt might have a salvage value between :35 and :50 for parts. He said if that make were in good shape it was powible for it to go 45 miles per hour at top speed as it had only low power. He told MI. Farmer the stopping distance was approx- imately one foot per mile of trav- elling speed. This machine had good brakes. he stated. Charlie Boston, 16. told Mr. Fos- ter he was near St. Paul's Church at the time of the accident. He said the car went through the stop sign. After the collision he stated the front wheelwss of! the hike and a running board gone from the car.
