We also find the present Chief Justice who was Attorney-General froln 1879 to 1889 and Chief Justice since then and during all those years one of the Fan- ning trustees with the Hon. Donald Ferguson (.`-ommissioner of Public Lands from 1879 to 1889 from time to time selling and giving deeds to and receiving payments from pur- chasers of this land. In fact I am told most. of the sales of these lands were made during these ten years. We also find another Fanning trustee, Attorney-General Frederick Peters with his Commissioner of Public _Lands the Hon. Angus McMillan do- ing the same thing. Is it now to be said that these men were cieeiving the honest farmers of this country by` selling them lands that the Province had no claim or title to? This will not readily be believed nor can I be- lieve it. ' It is claimed that there is no grant from the original proprietor of these 2889 acres. Did a grant ever exist? Or were there ever dealings with the proprietor that would be as'an cflec- tual barrier to his claim as a grant? Who can be sure that there was not? It is notorious that documents of a Public nature have been lost or stol- en from the Land Office. Is it reason- able to suppose that if--these trustees had any valid claim--to these lands that they would have,,remained silent. for about forty,-yee`,r`s"‘with li _know- ledge that another party was dealing with them? If they ever had any rights they have slept on them for forty years and it is now certainly too late to come forward with n claim to be paid when all the able* and careful men who signed the deeds to the purchasers and passed on their titles are dead and gone. Laches and estoppel are well known legal; terms and their application to this case--'is evident. Let the members on both sides of the _House vote this proposal down without the least hesitation. They need have no fear of ani' evil fam beialling the purchasers. The trustees will never bring an action against any of them and if they do there is no judge ur.cury,.in:.this. country who would listen to thilr. case for one mo- ment.
