You have Siven this matter careful attention-1 know of no case where more attention has b-en gii en than to what has transpired here. Gentlemen, I think this was nices- sary_ for this is a most important case; a case which will go down, in one way or another as a precedent by reason of the fact that it is the first case of the kind in the history of this Provin`ee_where a plea of in- sanity has been fought out in the Supreme- Court. For that reason, gentlemen, it is an important case. Although it has been termed a col- lateral issue-not the trial on indict- ment. it is not the less important on that account. There is a grave is- sue at stake in this case. You have to decide whether or not the prison- er is sane enough to take his trial -whether he is sane or insane- whether he is able to understand the nature of his trial, or to instruct his counsel. I have no doubt you recog- nise this I will not weary you by going over the evidence. What. the Crown has to do in this case is this. There must he no mis- carriage of Justice._ We have to put before you every scintilla of evidence; every fact; and throw such light op- on _it'as to enable you to' come to some understanding as to the tit- nessof the prisoner at the har to stand his trial. That is all. We do not' wish to make any insinuations such as my learned friend the coun- sel for defence suggested. I am sure that when we realize the de- plorable- condition of yonder man- the _prisoner at the bar-all our sym- pathies must go out to him. At the same time it is my duty to the Crown to see that there is no misunderstanding about this.
