Captain Smith, sworn : Could not identify the prisoner Johnston. Tis testimony was exactly the sane as taken before the Coro- ner, The Stipendiary Magistrate remarked that he would adjourn the case until Mon- day, hoping that the witnesses, Lynch and Curran, would be in attendance. He then, in the meantime, would he glad to hear any remarks from Mr. Hodgson as_ to whether the prisoners should be remanded for murder or manslaughter. Mr. Hodgson—There are two grounds upon which the remand should not be for murder, if you think the prisoners should be sent up for trial at all. The Magistrate here remarked that he had no doubt that the prisoners should be sent to the Supreme Court for manslaugh- ter. His only doubt was whether it should not be for murder. Mr. Hodgson—Assuming that your Hon- or will send the prisoners for trial, there are two reasons why they should not be sent for murder. In the first place, all the evi- dence h:s been given which can be ad- duced- As to the testimony of the missing witness; | am quite willing that his evi- should be read now ; but if that cannot be done, at least his ce;o3:t on may be looked at to be the evideace he may be expected to give when placed on the stand ; and as- suming him to state what he then swore to, there is nothing in his evidence to increase the charge from the crime of murder to manslaughter. You have, therefore, got every statement it is possible to procure. Then, again, consider that the prisoners have not availed themselves of any of the means of defence which the law allows to all accused men. We have examined no_ witnesses, cross- examined none of our opponents. Nor have I, nor do I now intend to comment E KELLY MURDER, MORTGAGE SALE 1 56 Acres, Lot 18, Frechold dd Acres, Lot 19, Frechold. D. 1878), at TWELVE O'CLOCK, noon, under and by Virlue of a power of sale, contained in an indenture of Mor gage, bearing date the Kighth day of February, 1877, and made between William McRae, of Township number Nineteen, in Prince County, in the Province of Prince Eecward Islaod, farmer, and Margaret McRae, his wife, of the one part, and Raiph Brecken, of Charlottetown Royalty, in Queen’s County, aforesaid. squire, of the other part, all the Freehold estate, right, title and in- terest of the said William McRae, in and to: LL that tract; piece and parcel ot A land, hereditameot and premises, situate, lying and being, on Township number eighteen (18) in Prince County, in said Province, and bounded and des- cribed as follows, that is to sav: com- mencing at Point of the march on Indian River, and on the division line between the Jands of Roderick Gillis and Samuel McRae, thence, in a southerly direction nineieen (19) chains and eighty six (86) links south, twenty six (26) degrees west, thence ina easterly direction for a distance of thirty one (31) Chains, thence in a north- erly direction for a distance of about fifteen (15) chains, or until it meets the edge of Indian River, aforesaid: theace following the various windings of said river, to the place or point of commence- ment, containing, by estimation, forty six (46) acres of land, a little more or less. ALSO, ALL that other tract, piece or parcel of land situated lying and being on Lot or Township namber Nineteen, (19) in Prince County, aforesaid, bounded as fol- lows, that is losay: By a Line commencing at a Stake set in the division line, between upon the testimony of the witness adduced; against us, and yet, notwithstanding this, even as the case now stands, would any reasonable man say that they were guilty of murder? If this Court possessed the power of conviction, would it send these two men to the gallows? Cer- tainly not. Then, too, remember how it may — nay, most certainly will—present itself when the prisoners case has been heard; when their counsel speak for them; when their witnesses are heard; when the witnesses for the prosecu- tion have been cross-examined, and they have availed themselves of all the means of defence which the law allows to those ac- cused of any wrong. If they cannot be held guilty of any murder now, a fortori how will they after a s'r.ct examination be charged of a crime which no reasonable man thinks has been, or can be, proved against them. Your Honor cannot but be aware that. many of the Crown witnesses, and those upon whose testimony this case will stand, are of a very indifferent character— that in fact they stand in the black book of this court charged with, and convicted of many offences. I have not gone into this matter, but the Court cannot but know it. Mr. Hodgson addressed the Court as to the distinction between murder and man- slaughter, and quoted many authorities as to the degree of malice requisite to support the former crime, and concluded by ex- pressing a conviction that the Magistrate would commit the prisoners for man- slaughter. NOTICE TO THE PUBLIC! HE GENERAL MINING ASSOCIA. TION (Limited) beg to intimate to the Public that the price of SYDNEY COAL has been Reduced to $2 per ton of 2240 Ibs., a price which it is hoped will place it within the reach of all consumers. The opening of the new winning at ‘“‘ THE SYDNEY MINES” and the facet that the SYDNEY COAL now being shipped is all from the DEEP taken in connection with re cent improvements in the process of screening, affords purchasers a positive guarantee of the very superior quality and condition of the SYDNEY COAL now offered for sale. It is a well-know fact that for many years ast the prices of other Cape Breton coals have en regulated by the rates fixed for SYDNEY COAL; but while it is true that other coals, to get a sale at all, have been pressed on the |market at various prices under the current rate of SYDNEY COAL, it is no less true that, taking into account the superior lastin qualities of SYDNEY COAL when compare with other Cape Breton coals, the alvantage, both as to economy and convenience, is in favor of SYDNEY COAL, even at a much higher price. The General Mining Association (Limited) regret that they should again have to caution the Public against the attempts being made from time to time to induce them to buy in- ferior coals purporting to be ‘‘ EQUAL TO SYDNEY,” ‘“*‘SUPERIOR TO SYDNEY,” etc., etc., while some yet more unscrupulous vendors have not hesitated to advertise their coal as SY DNEY COAL (from some designated locality). All these efforts to sell coal by such means are only so many admissions on the part of those who make them of the staNDARD character of SYDNEY COAL. it has come to the knowledge of the Asso- ciation that in frequent instances parties givin orders to truckmen and others for SYDNEY COAL have been furnished with other and inferior coal. The Public are cautioned against permitting themselves to be imposed upon in this way. Every vessel loaded at THE SYDNEY MINES is furnished with a certificate of the cargo being Sydney Coal. Parties purchasing should satisfy themselves by demanding the production of this certificate. The ‘‘ Sydney Coal” is registered under the laws of the Dominion, and unauthorized parties using the Trade Mark “‘“SYDNEY COAL” are liable to prosecution. CUNARD & MORROW Agents G. M. A., Halifax, N.
