This case was for an alleged in- infraction oi! the law 'at Stanley Bridge. The information was laid be- ioro the Cork of the County Court at Charlottetown and the summons was issued by the same clerk summoning i-Lie Defendant to appear before the Court at another circuit, namely the fourth circuit at New Glasgow. .Mr. George S. ilnman, K. C.. for tho defendant, riised three objections ti tho jurisdiction of the Judge to try the case. _ (1.) That the Clerk of the 'Court at Cha.rlo.ttetown had tio jurisdiction or authority to issue a summons for thc New Glasgow Court. ' (LL) That the dfendant was not duly summoned inasmuch as he was sum- moned to appear before tho County Court, and that the County Court as such as has no purisdiction to try Proliibition cases. (3.)’I`hat the Judge of the County Court had no jurisdiction to try the case inasmuch ns the defendant was not summoned to appear before the said Judgo but before the County Court.
