A.‘ At the third session of the prelim- ihlry hearing of the Anti-Pencil: "-9! 111 Gfififgetown Wednesday morning it warstated by Attorney- General Campbell that officials of ‘the United states Government are seeldifik to have the trial take place in the native country of the accused. in this connection Mr. Campbell stated that although the ship be~ longs to a lei-sign nation, the me- ment. she entered the harbor those on board became amenable to the criminal law of the country and therefore the courts here would have jurisdiction to try the case. The Am- erican Consul representing higher authorities states that his nation is desirous of having the prisoners sent back to the United. states, handed over to the American authorities and dealt with in the courts according to the law of that country. Mr. Campbell said he had not discovered any way in which this could be done. However, he asked that the prisoners be remanded for one week. One witness gave evidence, Sun- ter, a sailor, who stated that heaaw the prisoners enter the forecastle pre- vious to the shooting, and later saw Posselt look out then re-entar. The attorney general summed up tlieevidence against the prisoners and asked for an indictment. Mr. David Mathleson followed for the defence and argued for dismis- sal. While he admitted thlt there might be sufficient evidence to send Anti to the Supreme Court there was not sufficient evidence Ila-instalme- selt, who had nothing to involve him in thg injury or death of the boat- swain; Against» Anti the‘ only existent factor was his own statements, and the counsel therefore requested thot the charge of murder be dismissed.
