McKAY, late of Princetown Royalty, in the said Island, Farmer, deceased, and his Right, Title and Interest therein under the provisions of the Act of the General As- sembly of the said Island, 24th Victoria Cap. 5 upon a certain judgment entered on record in the said Court in a cause where- in James Yao was the Plaintiff, and the said Neil McKay was Defendant. IIEREAS application hath been made to this Court, on affidavit on the part of the said James Yeo, stating that the sum of fifty-six pounds, with interest thereon from the third day of January, one thousand eight hundred and sixty-three, is due to him on and secured by a certain judgment of record in this Court, at his suit against Neil McKay, since deceased. entered in or about Michaelmas Term, A. D. 1863, for the sum of one hun- dred and twelve pounds debt, and three pounds costs of suit, and execution on such judgment hath been moved for on behalf of the said James Yeo. It is therefore ordered, that unless all or some of the persons interested in the lands formerly belonging to the said Neil McKay, shall, on the first day of June Term next coming, in Prince County, come forward and shew cause‘why execution should not be issued upon the said judgment, at the suit of the above named James Yeo, against such lands, tenements and heredita- ments of the said Neil McKay, deceased, or his former right, title and interest therein, then eXecution will be issued against such lands and the tenements and hereditnmcnts of the said Neil McKay, deceased, in pursuance of the Act of the General Assem- bly of Prince Edward Island, passed in the twenty-fourth year of the Reign of Her present Majesty, intituled “ An Act in ainenda' ment of and addition to the Acts relating to Judgments entered of Record in the Supreme Court of Judicature.” On motion and affidavit of Mr. Longworth, of Counsel for the applicant. ' Y virtue of two several Writs of Statute Execution to me directed, issued out of Her Majesty's Supreme Court of Judicature, at the suit of James Bourke, against Joseph Kellow, I have taken and seized as the property of the said Joseph Kellow. All his right, title, and freehold interest, in and to one-fourth of Town Lot No. 9, 2nd range letter F, in Georgetown fronting on the Western side of Kent Street 30 feet, and extending back 84 feet, a little more or less, with the building thereon erected; and I do hereby give Public Notice that I will on the 12th day of April 1867, at the Court liouse in Georgetown, at 12 o’clock, noon, set up and sell at Public Auction, the above recited property, or as much thereof as will satisfy the amount of levy marked on the two said several Writs, one Execution being for the sum of £80 8s. 0d. with inierest on £60, part thereof, from the 30th day of March, 1865, until, paid. besides 16s. 8d. for said writ, Sheriff’s fees and incidental expcnces; the other Execution for the sum of £39 55. 2d., with interest on 1133, part thereof, from the 30th day of March, 1865, until paid. besides 168. 8d. for writ, Sheriff’s fees, and incidental expenccs.
