I never saw Jack Hughes in the row after the first part, nor did I sea Carroll interfere at all. Jack Morgan I was in the muss too. Ile struck Peter Proud once. That was all I saw him do. Charles Thorne struck either Rodd or Peter Proud during the row. That is all I know about it. Peter Proud (sworn), I am a brother ofthe decea=ed. Iam hired at Wm. Howards’ North River. I drove my mother into town on Monday last William came in on the train that morn- ck’s corner. Just then Wm Proud i ng, James Carr, my brother \Villiam, Gcirge Rodd and I went down to Spring Park Road between 6 and 7 o"clock to trade horses with Carr. They did so, when I got in I turned the horse back. asked them to get out,'I`rainor refused, but afterwards got out and wanted me to get out and tight. I can’t just re- member whetlrr I got out or was pulled out. I think it was Trainor who hit me before I got my feet onthe ground. Hughes, Trainor, Thorne and Daniel Carroll were :here but I don`t remember having seen Carroll do anything at all. I I got so excited I dou’t remember much after that. The row had not started long before William and Carr came along. Tie other felio :vs had not knocked me down. I don’t remem- ber anything oi the fight after that, l had to watch myself and do not know who struck my brother. John Trainor and John Hughes were the two who were at me. 'Trainer hit me more than once, I bled a good lot. There were others at mv brother and I did not want to get into the carriage unt.l I got him out of the row. I was so excited with the blows I received that 1 can’t remem- ber exactly what took place. William would be about 20 yards from where I was, when I got struck, Thorne was not in the crowd where I was, I never got near my brother until he was put into the wagon. I don’t know whether he got in or was pun in. I can’t Ie- member what took place from the time I was struck until I saw my brother in the wagon. I was kicked in the side once by some one from behind. It was about the same time as I got struck first. The only reason he knew -for Trainor and Hughes. They seemed the worse of liquor. I know of no previous grudgs existing. Thorne was not in liquor as far as I could tell, l had been drinking alittle but knew . what I was doiugarzd did not interfere 1 with any one. George Rodd (sworn) I live at Nerth Wiltshire, I work on a farm: I 08130 into town Monday. _I met Peter Proud at the round house and William Proud I at the station. We walked around for a time and then went to Connor’s stable where -the horse was. We parted at I 4.30 and met again at 5. We started dcwn to Carr`s place" and stopped in front of Thorue’s. Wm Proud and Carr went down to Carr's house. I got out of the wagon but Peter did not get out. I spoke up and told Trainor he had better get out of the wagon, that Peter was a little on the beer. I was drinking too. Trainorgot out after a white aud then tried to strike Peter. Peter then got out of the wagon and got into a fight with Tiainor up. His head was leaning helplessly on my shoulder. I asked him if he was sick and pulled him up towards me on the seat of the wagon. Some person brought some water. We lifted Proud out and laid him on the grass. I started up town to get a doctor and his mother. 1 met his mother at Hughes’ corner and she went out with Peter. Edward Hughes was there too doing like the rest of them, putting in a lick when he could. There were a. good many peo- ple around. Wm Proud fell on the ground from the blows. First Thorne struck him. then Traiuor and John Hughes made a lick at him and Edward Hughes was doing what he could. I told Thorne he shou:d not have struck Proud. He was out to our place to a dance last winter and we used him right. I know of no previous reason for the quarrel. Neither Peter nor William were into Thorne’s that evening- Robert DeBtois (sworn),-I remem- ber the evening of the row. At the corner of Spring Park Road and Bav- iield §t.. 1 saw a large crowd opposite 'l’horne’s. It seemed to me like a gen- eral sculile. I asked if they had sent for a doctor and some one said they had. The tight was over when I got there. I saw Carroll, and he. did not appear to me to have had an thine' to do with the Y .s affair. I was speiking to him and hex seemed quite cool. I saw Trainor there; ft he had his coat off and seemed very much excited. I saw John Proud. and he seemed greatly excited too. He told me deceased was his cousin. I did not see George Thorne, Edward Hughes and John Hughes. Peter Proud was in a very excited stale. Mrs John Garrick (sworn)--I live on on the corner of Spring Park Road and Chestnut St., nearly opposite Tl1orne`s. I was in the shop last Monday evening. My little girl came in and told me there were four drunken men_ outside in a carriage; I went right out and saw the carriage opposite Thorne’s. Some of the men were in the carriage, others out. The only one I knew was James Curr; I saw John Trainor and John Hughes. They were out of_ the car- riage. I saw Trainer take his ccat off. After that Traiuor and Hughes got into the carriage and drive down street a short distance and came to Thorne's. I don"t remember if there was any one with them. They got out of the car- riage. I saw there was a scuiile, but standing at my own house I could not see any particulars for the cro’wd. I saw Edward Hughes making an attempt to strike some person but could not see who it was. I saw Charlie Thorne also make an attempt to strike some person. I saw John Morgan attempt to strike one too. I did not see George Thorne; About 5 minutes :after I heard the man was dead and I walked over aad saw him lying on the grass.
