The following judgment was de- livered in the Countv Court. yestrr- day in the cnse of Eric Pcnderfzast vs. Athol A. Judson by His Honor C. Gavan Duffy. Mr. M. J McQunid appeared for the plaintiff and Mr. R R. Bell for the iicfcndent. This is an action for trespass and damage to 8 ncres of oats of pluin- tiff committed by defendant's cows breaking in and dcstroygt; the oats. The trespass and age is admitted. There was evidence that the cows came into the plaintiff's land on two occasions through a gap left in a wire fence on the plaintiff's part of the fence on the farm boundary and were put out by the defendant. But he swears, that on these occasions they got no further than a hay field. No claim is made for this trespass On at least two other occasions a herd of fourteen of defendant's cows were found. in the field of oats. and it is not shown how long they were there. They came in from the de- fendant's pasture adjoining which was a fence which it was the de- fendant's duty to maintain. 'f‘he_v damaged the grain. The plaintiff claims that in consequence the oats was not worth cutting. It is Only B matter of assessing the dam- mages. ‘I110 plaintiff estimate of damages at $125.00 only a e-ueel. estimated on whet t e field wmrld have returned This fr manifestly too high. P‘ The evidence of the defendant's witnesses places the value of the outs very low. but they saw it after the cowe had done the dam- age. In any cue the plaintiff was en- titled to have the oats harvested for what it was worth and the de- fendant must answer in damages. Any estimate of damages is only a guess and I place it as low as f consistently can. I place the damages at $5.00 per acre or e total of forty dollars. Judgment therefore will be en- tered for the plaintiff for fortv dollars and coet; including e coun- sel foe of t/wentv dollar-I. WIDNIBDAY MB. ANGUS DESI-GORE!
