The sum of three dollars was a very? paltry amount, but it might prevent persons from calling ajury, when there was no necessity for one. The hon. member also stated that 9. necessity existed to have juries because cases were‘ decided by___ the lawyers not in accordance with the laws passed by this Legislature but by the common law of England and by precedent ; but a jury would not pre- vent this—the jury only’ decide facts, they have no power to decide questions of law.
