In the Court of Review vesterday the Hen Justices Torrance, Rainville and Jette heard the arguwents in a case which is of great importance in connection with } the Governn cnt lottery scheme. The case wes that of Mercier rs. Gervais ef al, in which the plaintiff eved for a sleigh which he claimed to have won at a raffle. As has before been reported, Mr. Mereter won |his case in the Superior Court Messrs, |} Barnard, Beauchamp, and Creighton, act- ling for the def-ndants, carried the case linto Review, where, besides arguing the facts of the case, they contended that. the suit must fall to the gronnd in consequence of the iNegality of lo teries In the reign of Willism §ML an Act was jassed declaring lo teries to be raeners. and visitimg thee comdac- tora with the porishment due tu regnes. Sudseaventiy the Engi sh Parliament auth rized the holding of sate lortentes, but. as this was afer the Queb ¢ Act of 1774, the former statute passed into Can- adian law, while the latter did not. Thus, it is held, the holding of lotteries is an in- dietable offence, and is consequently crime.
