SUPREME COURT, Before the Chief Justice and Mr. Justice Fitzgerald. Khabell Sharbell vs. Peter J. Solo- man. The Chief Justice and Mr. Justice Fitzgerald gave judgment this morning ordering the defendan'’s im- trom Prince County jail. It was an application for a writ of Habeas Corpus on behait of the defendant who bas been a prisoner ip Prince County jail siuce March last. The facts and circumstuncesr:-lating to the defendant’s imprisonment are rather complicated, but it appears that defendant was arre:ted uuder a capias issued outof the County Court of Prince County for under $32 and instead of being taken immediately before a Justice of the Peace nearest to the plaintiff and days and then taken before Leonard Morris and Joceph Murphy, justices at Summer-~ side, who tried the case and Morrie issued an execution which detained defendant in jail. Neither Morris nor Murphy was the nearest jutic? to the plaintiff. There were a lJarge number of legal ques- tions argued yeetirday when judgment was reserved until this morning. The Court beld that defendant was illegally imprisoned from the first and ordered his discharge forthwith, that he should never have been imprisuned on the capias, that the magistrates at Summerside bad no jurisdiction to try the case, that their proceedings were not only irregular but void and that the execution issued by Morris was also absolutely void. Morson, Q. C., for the plaintiff Sharbell ; Stewart, Q. C., for the defendant Soloman. Mr. James D. Hyndman was called to Mr. McLean, QC. James Bradley vs. Henry B. Smith. Action of trespass tried Jast Hilary term before Mr. Juetice Fitzgerald without a jury when judgment was reserved. Mr. Justice Fitzgerald this morning gave judgment for the defendant. Upon motion of Mr. Moreon, Q. C., for the plaintiff the new trial was extended until next term, The Court adjourned sine die.
