Our Mayor and Councillors elect,If such they are, have chosen to sro on assuming notwithstanding their nominations were not filed with the City Clerk as by law required, that they have been legally and oonstltutionally elected. As we before said there ara various opinions as to that question, and we incline to think tha weight of legal opinion is against the validity of the election no far as the point in question is concerned. But another and equally vita' point is aow and here raised, for the first time. 'I`o make it clear we suhjoia the first part of section 14 of III I-Idwarii VII Cap iT. under which our civic candidates were nominat- ed. It reads as follows: 14. Seven days before the time of holding any and every election for Mayor ‘election began I Of course the defect can and Councillors, tba persona, candidates for the omoe of Mayor or Councillors, shall ‘ive in their names as such candi- dates mths City Clerk . _ . This was dcne in all cases on Wednes- day tha 3rd day of February, between 12 and 4 o'clock, and the election was held on the 10th day of February, beginning at 9 o'clock. It seems obvious to the most casual reader that the third day is not seven days before the tenth day. There are only six days between the third and tha tenth, to wit the fourth, fifth, sixth, seventh, eighth and ninth days. The law requires seven clear days be- tween the day of nomination and the day of polling. Maxwell on the Interpretation of Statutes, page 487 makes this clear. We quote: Again when ao many “clear days" or so many days “at least" are given to do an act, or, “not lenathan" so many days are to intervene, both tha terminal days are excludei from the computation.
