of the Senate or House of Commons are rendered incapable of being appointed to the Legislative Council or of being a mem- ber of the Legislative Assembly.” The Act further declares thatthe votes given for such a candidate are thrown away, end instructs the returning officer to return the candidate having the next highest num- ber of votes in any case where the ineligible candidate has the highest number of votes. On the fece of it, the Act applies to the Province of Prince Edward Island, end that contention is strengthened by the fact that the Act of 1873 expressly applies Acts passed in the Parliament of Canada to the Provinces which shall come into the union as well as to those which had already entered the union.

THE act oF 1874,

while it minimizes the judicial functions of the returning officer,does not repeal the Act of 1872. There is no doubt at ali that this Act of 1872 did not apply to the province of Prince Edward Island up to 1876. The condition of things which is presupposed by the Act of 1872 had not up to that year been operative in the Island province, but inthe year 1876 the Island Legislature ‘adopted a law which rendered the members of the committees incapable of sitting in the Legislative Assembly of that Province The moment that was done, the Dominion ' Act of 1872 came into force, and the effect is that, since that date of 1876, no man in that Province could become a candidate for \the House of Commons who was at the time a member of the Provincial Assembly. It rested upon those adverse to this natural and logical conclusion to show that the law of 1872 was repealed or was inoperative, and upon this point the discussion waxed ,warm. The question involved a nice point | of law; but the burden of proof rested upon ‘those who declared that the plain enact- ments of the law of 1872 were in operation, | because the law was repealed. It was for |them to show when and where this ‘law was repealed. It was just here their difficulty began. There is no repealing clause anywhere fin the subsequent Acts. There was none quoted by those members .of the committee opposed to Mr. Mc- ‘Carthy’ s amendment to Mr. Weldon’s ;motion. If it could have been shown that the explicit provisions of

any other of the ridicuions rumors which you have heard.” In answer to other ques- tions His Excellency said he had become attached to the people of America, and he hoped that the two coantries lying so close together might always have the same feel- ing for each other that prevails to-day.

Death in the Portland Police Station. About 7 o'clock, last evening, a man

named Joseph McDonald was brought in a carriage to the Portland police station by John Krowles, an employe of the Inter- colonial Railway He had fallen in a fit in the railway passenger depot, and as there was no place to put him in that vicinity he was teken to the police station. Officer Collins was in the station at the time, and had to assist Knowles and the man with him to carry McDonald into the lock-up. The unfortunate man was unconscions at the time, and the officer in charge tried to bring him too by throwing water on him but without avail. He was not put into a cell buat placed on a bench in the hall. At 8.30 Sergent Hamilton puta man in one of the cella and noticed that McDonald waa all rivht. At 10 o'clock, officer Colling visited the celis and McDonaid was breathing, but groaning as ifin pain. He had fallen from the bench to the floor, but as it is not an unusual circumstance for a wan under the influence of liquor to groan, no particular attention was paid to him. About ILI o'clock Captain Rawlings sent Policeman Colling in to see how the sick man was, and he was found lying on his back dead He did net appear to have changed his position from the time when the cflicer last saw him alive, and had apparently died without a str uggle. The body was lifted from the floor to a bench, and the coroner notified.

McDonald is a ship carpenter by trade, and, although a native of Prince Edward island,thas been a resident of St. John and Portland for some years He has on several occasions recently been befere tho Portland police court, and by reputation is a hard drinker. On Thursday evening Ofiver Joseph Woods found him lying

Blake retired from the committee before the vote was taken. It would certainly ‘have been better if the optnion that the Act of 1874 repealed the Act of 1872 could jhave prevailed. But in the face of the facts that was impossible. Inu strict law, the seat was Mr. McDonald’s, and there was no help for it. Mr. Richey held so strongly to the equity side of the case that he voted to declare the seat vacant, but those who felt bound by the strict interpre- tation of the law az it stands, represented

him by the magistrate, in a rational man- nev. Mr. Joseph Sullivan, with whom he nas worked, became suroty for the fine im- posed and McDonald was set free.
