CAPE BRETTON.

A good deal of excitement, we learn, prevails at Sydney, Cape Breton, relative to the case of M‘Quade, a deserter, lately shot, it is supposed, by Lieut. Green, ct the 88th Regt., in resisting an attempt to capture him, ‘The versions of the matter gre two numerous for publication, nor would we wish thereby in any way to pre- judge this case; but from what we can jearn, it is beyond all doubt the duty of the Crown officers forthwith to order a full investigation. The justice who at- tanded to assist in the capture was pre- sent when the deceased was shot, was the saine party, it seems who presided as Co- roner. Nothing could be more injudi- eious or ill-advised, if the fact be so ; and any gentleman who could so violate for any cause, the first principle of reason and common sense, should be at once superceded. The verdict of a jury to that effect, delivered ina Court of Law, and nothing short of it, will satisfy the public that this is a case of justifiable homicide as found by the Coroner’s Jury. We are desirous of being understood, however, as passing no opinion upon the merits of this uafertunate occurgence,
