The Recent Decision—A Protest.

Sir, —I noticed in the editorial remarks

in your issue of yesterday, on the recent appeals to the Supreme Court at Ottawa, ! a sentence which refleets rather upon our) Supreme Court Judges here, atid in which | you say that ‘“‘for their own credit they, should give more study and consideration | to the cases which come before them.” It’ is to be regretted that you should, through

the columns of your paper, attempt to| ; |

weaken the respect which is dus to our Supreme Court, and were you better in-' foruved of the particulars of the two cases pon criticise, you would have hesitated be-

-fore doing so.

Both these cases turned upon the interpre- |

‘tation of Statutes, one of the most difficult

questions with which lawyers and Judges! have to deal; and one upon which the minds of Judges are rarely in accord. The rule3 of construction are,trne,well establish- ed, but the difficulty arises when they are

accurately and carelessly framed. Had you occasien to read the decisions of the ablest Judges in England and America you | would find that these Judges, while con-, stantly differing among themselves, and! from the{J udges of the Court appealed from, | invariable admit the difliculty in determin- | ing the true construction of Statutes, and, give their opinion with great hesitancy, and with every respect for the opinion of those! differing from them.

Witli reference to the two cases you cite, I unhesitatingly say that never wes a charge more unjust or unfounded than the one you make. In the matter of the appeal of the | Shareholders of the Bank of P. E. L., the counsel engaged in the cause can inform: you, that the judge who decided that case, not only listened with great attention to the lengthened arguments made before him, but of his own accord suggested a postpon- ment that certain fagts which he deemed matcrial might be elicited. The two lengthened judgments which he afterwards delivered show a research and a study which only a conscientious able man could give; every important decision bearing upon the question wasquoted ,and carefully analyz- | ed. The full, text of the decision of the | Stipreme Court at Ottawa is not yet in’! print, but I am satisfied when it does ap-; pear, that though it will reverse Judge Peters decision it will recognize the ability of his judgment and _ the. great’ difficulty. there was .inm -erzjving. at a correct determination of the in- tent of the Statute under review. Jn the business of the Liquidation of

this Bank, no Judge could have possibly

shown greater industry, or taken a more active interest in its successful termination. Prompt judgments have been given in every case; and the present highly satisfac- | tory atate of the Liquidation proceedings is largely due to his untiring energy and ability.

In the other case, our Judges wisely de- | clined to reverse the well-known and well- | established rule as to the service of netices of dishonor where both parties reside in the same place, tintil the highest court in the land had authoritatively decided what jn‘erpretation should be given to the mote than ambiguous language of the Dominion Statute regulating such services. This course was unquestionably the wisest one in the interests of our whole commercial | community. Had you listened te the argument, and heard it openly stated in Court, by lawyers of undoubted standing, that in many of the largest cities of the Domimion, the practice there, was the satis as our own, you would have hesitated before using this decision as a text to decry the judicial capacity of our Bench.

In conclusion, Sir, as a member of the} Bar of ihis Province, [ protest against the use of such language as you have seen fit to use in thisinstance. It is not in accord- ance with the truth. It is condemned by all right-thinking men; and it is an un-)

pains-teking discharge of their

Here is another one of those anomalies which make. the Section B slander story appear so ridiculous. Canada was informed by the Reform lead- ers that the Canada Pacific Railway syndicate had the Government completely under its thumb, and could compel it to do just what it pleased. But according to the Section B yarn the Government has the syndicate under its thumb; indeed, so thoroughly is the syndicate under the con- trol of*the Government that Sir Charles Tupper is alleged to have forced the ofticers of that corporation to purchase frem Shields Manning & Co.. the plant of Section B at a price far in advance of its value. Now, o:@ of these stories must be untrue. It is impossible for the syndicate to be under the thumb of the Government and for the Government at the same time to be under the thumb of the syndicate. An explan- ation is respecifuwly solicited.—Teronto Mail.

It was authoritively announced the 19th inst., that Groff, Bennetts & Co., iron manufacturers, Pittsburg, Pa., have called their creditors to meet to-morrow, and will ask for an extension of time. They will offer one-third their liabilities in instal- ments, in three, six and nine months, and the balance in three years, with ample security. Itis considered that an extension will be granted. The liabilities are $1,- 550,000 ; assets $2,000.050, exclusive of real estate, which is worth over a woillion, and believed to be unencumbered.

The Milton Hydraulic Mining Co’s reser- voir at Smarkville, California, containing 650,000,000 cubic feet of water, burst on the afternoon of ike 19th inst. The rush of water was irresistible and swept away everything from its path. It raised the middle of the Zaba river one hundred feet. The roar of rushing water waa heard several miles-away. It carried away all the bridges,. Several lives are reported lost. Loss to reservoir 875,000.
