Prisoner was sober, the soldier the worse of liquor. ; The first hearing was on Saturday the 16th. On the prisoner intimating that he wished to call evidence on his defence, he was told that bail for his appearance on Tuesday—this day—himself in £50, and two sureties in £235 each, would be taken, and that subpoenas for his witnesses would i be granted him,and that he might employ Counsel 1

if be pleased.

On being put to the bar this day, Tuesday, the evidence was read over to him, as was the clause in the Mutiny Act under which he was ’ tried, and asked what defence he had to make. l His reply was “ he was not aware of the law of the case. He never refused any man a ride when asked. He was not aware of any harm in asking a man to ride on his truck. That being confined in Jail, he had no opportunity of sending ‘ for witnesses.”

Councillor Theophilus DesBrisay, Esq., who with Richard Ileartz, Esq., heard the case, after reminding the prisoner that he had been remand- ed on Saturday for the purpose of enabling him to procure witnesses, and might have done so—-— stated that the duty of the court was very plain, and that the evidence was most conclusiveagainst i him. That the Court could not believe that he was so ignorant as he pretended to be, after all that had been said and printed respecting des- : erters. That he must have known that he was doing wrong. That the attempting to persuade or entice men to desert was a serious misde- meanor, and that it was the duty of the Court to ; mark and punish it when detected. He then sentenced the prisoner to be inipi-isoned,:iiid kept at hard labor in the Jail of Charlottetown for six calendar months. He reminded him that he had the right of appeal from the decision of the Court, and that it was open to him to apply to the Executive for a mitigation of the sentence.

Penalties for Aiding Deserters.

By the Imperial Act for punishing Mutiny and Descrtion, any person who shall by any means whatsoever. directly or indirectly, procure any Soldier to desert.or attempt to procure or persuade any Soldier to desert, and any person who know- ing that any Soldier is about to desert, shall aid or assist him in deserting, or knowing any Soldier to be a deserter,shall conceal sucn deserter, or aid or assist such Dcserter in concealing himself, or aid or assist in his rescue, shall be deemed guilty of a Misdemeanor, and shall on conviction thereof, before any twu Justices of the Peace acting for the County, District, City, Burgh or place where any such offence shall at any time happen to be, be liable to be committed to the Common Gaol or House of Correction, there to be imprisoned,with or without hard labor, for such torm,not exceeding Six CALENDAR MoN'rHs as the convicting Justices shall think fit.

Any Tavern Keeper or other person suffering a Soldier to remain in his or her house after the hour of nine in the evening, from the lat of May, to the 30th of SEPTEMBER; and after the hour of Eight in the evening, from the lat of OCTOBER to the 30th of APRIL, without a. written pass from his Commanding Officer,shall forfeit TWENTY Smomucs for each and every oflcnce, with costs of suit.

TWENTY POUNDS PENALTY.

By the Island Statute of 50 George the Third, cap. 3, any persons harbouring, concealing or assisting any Deserter from Her Majesty’s Army, is also liable to a penalty of Twenty Pounds.

Any Sheriff or his Deputy, and any constable, or Ollicor or Soldier in Her Majesty’s service, are by the some Act authorised to apprehend any person suspected to be a Deserter, and take him before a Justice of the Peace.

FIVE POUNDS REWARD is by the same Act payable for the Apprehension of any such Deser.
