Hence it is that a member of _ the Parliament of Great Britain cannot resign his membership. By statute, however, the acceptaoce of an office will vacate a seat, and & member desiring to leave ap- plies to the Government for an appoint- ment, which is always given him, and which he reeigns the next day after his object is attained. In the Water Commissioners Act no such provision ia made, and the power to resign not being a common jaw right and not be- ing given by Statute, it follows that the Water Commissioners cannot voluntarily resign. lo the present instance, however, the Legislature bas not only not given the Commissioners a right to resign but has declared and enacted that they shall (which I understand to be an imperative word) hold and continue in office untill Febuary 1902.

The arguments advanced by your cor- respondent that a right to resig. does exist might have been fairly put forward to the Legislature to induce that body to give the power in theact. As it is, they may be used as illustrating the bungle made in the drawing and passing of the act.

In the materaal care and anxiety of the Legislature that Mr. Laird ehould oot rua the chance of losing his seat at an election, that body, of course knowing the common

lew, legislated him into office for a given pericd. That period has uot expired, and no provision was

made to vacate the seat in the meantime. This is the whole care ina nat shell, and it will require an act ot the Legielacure to relieve Mr. Laird from the duties of Water Commissioner. To obiarn that act Mr. Laird and the citizeas must wait until the Legisiature meets next spring unless the Farguhareoao Government follows the example of their Liberal brothers in Qutario and calls a speci.! session to amend their bungling legislation.
