\Vbat makes this case still more distressing, is the circumstance ofthe poor boy's being new incarcerated in Charlottetown Jail, liir an action ofa precisely similar nature, brought against him by the same person, and before the same magistrate (this last men- tioned gentleman acting the various but somewhat incongrumis parts of “’ill-drawcr, Counsellor, and Judge in his own Court, and principal witness in the Court above), and as in this last case, the boy neglected to bring out an appeal to the Supreme Court, and being unable to pay the fine, and the expenses ofthe prosecution, execution was issued against him, and under this execution he was sentenced to Twenty-one days’ imprisonment in the Common Jail of Charlottetown. The ChiefJustice (in a manner which did justice to the humane feelings of his heart) repeatedly expressed his sympathy for the poor boy, by pronoun— cing it a very hard case; but it seems the thing could not be hula ped—thntnothing would do but f_‘ the pound of fiesh”—-that such was the law, that the poor boy mist be found guilty of an act of trespass for cutting a few’ insignificant sticks ufiinibcr (not per- haps worth five shillings) on his own father’s property—mud for this high crime and misdemeanor, though the main support ofhis widowed mother, and four small, helpless children, he must lie for Twenty-one days, at this mostimportant season of the year, in the common Jail ofClIarlottetown. After such instances astliis. what will future generations think of the equity and humanity of many ofour boasted-ofEnglish laws? Our wise Salons and pre- iendcd friends of the poor people of this Island, as il’tlie law of trespass had not been sufficiently strict and favourable to the pro- prietors before, have by their explanation Or mis«mendment of that law, in the last session of the House of Assembly, proved themselves to be the most strenuous advocates and supporters which the proprietors themselves could have employed. So much for high-sounding pretensions of patriotism, and sympathy for the poor settlers and tenaiitry of this Colony!
