SUPREME COURT, PRINCE COUNTY.

The October Term of the Supreme Court of Judica- ture, opened at Saint Eleanor’s, on Tuesday the third instant. :

No criminal cases were tried; the Grand Jury hav- ing ignored the Bill of Indictment against several parties charged with having assisted the prisoner- De Roche in breaking the Jail, and escaping from im- prisonment. A Bill was afterwards found against seve- ral parties for obstructing the High Sheriff in the ex- ecution of his duty, anda Bench Warrant issued for

their apprehension.

Mary Borthwick, Administratrix, vs. Charles Binns, Esquire. Mr. Charles Palmer for the plaintiff, stated this case, as brought for money had and received by the Defendent, being the proceeds of land sold, belonging tothe Estate of John Borthwick, deceased, and which, it appeared, had come to the hands of Defendant, in his capacity of Executor of Robert M‘caul, deceased; the Defendant pleaded the general issue. Verdict for Plaintiff for £100. Mr. Lawson for Defendant, obtain- ed a Rule nisi for a new trial, to be argued at Charlot- tetown next ‘Term.

Lemuel Cambridge, vs. John Mann.—Mr. C. Palmer, for Plaintiff, stated the action to be for £70 11s. 6d., for coods sold, and an account stated and settled, subject to some items of set-off. ‘I'he question turned chiefly upon a settlement had between the parties in 1846— Verdict for Plaintiff for ¢49 odd.

A summary Cause and several Appeals were after disposed of, and the Court arose on Friday evening.

Tue Smart Pox at Picrov.—The following is an extract from a Letter from the Rev. J. Waddell, one of the Passengers in the Brig Lulan, arrived in Pictou from Glasgow, the Steerage passengers of which are sick with the Small Pox:

“It should be particularly mentioned, that there was no apearance cf disease among the cabin and after steerage passengers (the miners,) and that these were all landed and seperated from the poor people who were suffering so severely.

“Our party and the miners, are showing no indica- tions of having caught the infection, and if they on the’ other side of the water are enjoying the Quarantine as

“There is much in the history of the expatriation of those poor Highlanders, which calls for severe repre- hension, and indeed, the Scotch papers animadverted very severely upon the treatment they met with after they left their homes, and before they embarked with us. A penalty was recovered from the shipping agent who disappointed them, and placed in part, in the hands of Capt. M‘Kenzie for their benefit. They contracted | fora passage directly from their own homes to this country, and were thrown ashore at Glasgow, where be- yond doubt they caught the disease that is raging amongst them ; and they have now to find their way, as they best can, to Cape Breton and P. E. Island. ‘They were inavery unfit condition to undertake such a voyage ; the wonder is, that they did not suffer more.— Their circumstances excited sympathy in Glasgow and Grennock. Religious tracts and Bibles for such of them as could read, were entrusted to passengers to be dis- tributed amongst them, and from a Benevolent Society, a considerable quantity of Oatmeal was furnished to Captain M‘Kenzie, to aid them on their way, after being landed on our shores. Nevertheless they have much to complain of, and I hope the question is now being seriously entertained, whether suflicient provision has been made for their safety and comfort in the temporary sheds where they are now lodged. If the weather be- comes wet and cold while they are there, they must still suffer much.

It is supposed that the disease will likely extend through the whole of the Highlanders, upwards of 90 of whom are now afflicted with it. The following are the names of the cabin passengers: Rev. Mr. Waddell, Rev. Mr. Honeyman and lady, James Carmichael, Esq., Mrs. Grant, Miss J. Dawson, Miss J. Carmichael, Messrs. J. A. Dawson, and D. Faichney.

Prcrovu, Oct. 5.—The Bark Lulan has been released from Quarantine. No symptoms of infection appearing among the cabin passengers or Miners, they have been released from their irksome detention at the Beaches. The Highlanders, however, are detained, many of them being still labouring under small-pox. Several deaths have occurred among them, during the last week.

the Royal allowance to the act passed at last Session of the Legislature entitled .4n .4ct to Incorporate a Mutual Fire Insurance Company—Notice is hereby given, that in pursuance of the Eleventh Section thereof, a members’ Book will be opened at noon on Monday the Second day of October next, at the Office of the Hon.
