court was compelled to take notice of them. Judges Sethe, Gill and Loranger sat on the case. They were uoanimous.
Mr. McShane was fined $400 and condemn ed to lose his civil rights for seven yeara, Mr. Laurier and Mr. McShane have each said that this sentence was set aside by the Court of Appeal. There is not the slightest foundation for any such state ment. The case never came before the Court of Appeal on its merits. It was never reversed. It was nevereven argued Mr. McShane applic ito the Clerk of the Court of Review for a writ of appeal which the clerk refused to grant, holding that

Mr. McShane’s counsel asked the Court of Appeal te di- rect the clerk of the Court of Review to iene a writ in appeal The ground on which such a writ was sought was not that Mr. McShane had been wrongly found guilty of corrupt practices, but that he should haye been condemned by the single judge whotried his case and not by the three judges who satin review. Mr. Justice Loranger discussed the point when judgment was being given. He pointed out that there were two construc tions to be put on the law. He consider- ed, however, that what hecorvld doasa judge of the Superior Court sitting alone he could do as a Judge of the Sup- erior Court sitting with two colleagune. His associates coincide! in this view. It was to geta reversal of this decision that Mr. McShane appealed. Chief Justice Dorion spoke for the Court of Appeal. He was mostemphatic in explaining that the merits of the case were not gone into in the decision he was renderiug. “The question,” he said, “comes to this: Is this e¢ondemnation against McShane a matter arising out of the election petition, or a matter requiring thedetermination of the Court of Review ? The ques tion is one of great difficulty, and there is

a great deal to be said on both sides. The Other parties interested have not been heard. The case is surrounded
with such difficu'ties that we think we should not deprive the party of his right to appea!. We order the writ to issue under all reserve, so that both parties may be heard, and then we will determine whether an appeal can be entertained.”
So far from the condemnation cf Mr Me Shane being set aside, the Court of Appeal did not even decide whether it had power to interfere in the matteratall. It merely ordered that the case should be brought before it forargument as to whether this power existed. That wasthe end of the niatter. The petitioner in the case had gained his purpose when the seat in the wegislature that Mr McShane’s corruption had secured to the Liberals was vacated. Mr McShane did not dare to press the case It remained on the roll till it was dis charged in the course of time, on account of no proceedings beingtaken. That how ever, did not set the judgment of the Court of Review aside. That judzment was suspended pending the appeal. When the appeal failed from any cause, the judgment revived. There is ground for arguing that Mr McShane’s occupancy of the Mayor’s chair in Montreal was contrary to the law. There is nota line in the re- cords of the courts to support the conten- tion that Mr. McShane’s character ha: been vindicated. He is, and remains, a convicted briber and corruptionist. The records of the House of Commons are ex— tant to prove this. The records of the courts are in evidence to establish it. And Mr Laurier is in alow bnziness when he rises in his place in Parliament to contra- dict them.

The annual report of the Militia De partment was presented yesterday. The total expenditure of last year was $1,574, 013. The Deputy Minister says that the Superintendent of the cartridge factory is now in England undergoing a course of technical instruction tor the manufac- ture Of ammunition for magazine or small bore rifles. The necessary machinery has already arrived.
The permanent force has been reduced to $00 by the release of some of the rank
and file. The establishment list shows a total authorized strength of 28,962. The pumber of ofticere and men who drilled
