suages, lands, tenements, buildings, real or personal/ estate, shall be and remain vested in the sai f corporation, to be used and disposed of, however, for the benefit of said congregation according to the’discretion ofsaid corporate body.

V. It shall and may be lawful for the said corporate body for the time being, and? they are hereby authorized and empowered to grant, sell, lease, exchange, mortgage, convey or dis- pose of, to such person or persons as they shall think proper, and for such prices, sums, rents or terms as shall be agreed ripen, the whole or any part of the, said lands or premises now held 0: hereafter to be conveyed to or held by. the said corporate body, and to such extent and ,‘prqportion as they shallthin‘k proper,,and every .Ideed or conveyance thereof executed by the said trustees in their name of office, under their common seal, shall be valid in law, to convey for years or otherwise,all such estate, title and interest as the corporation» of the said Baptist Church have, or may hereafter have, in the same. .

VI. It shall .not be lawful for the said corpora- tion to hold real estate for the use of the said. congregation which shall exceed in value and yield at any time more than a clear net yearly income of two hundred pounds currency of this. Island. ' '

VII. This Act shall be deemed, a public Act, and shall be judicially taken notice of as such by all Judges, Justices oft-he Peace and minis- ters of justice, and other persons whomsoever, without being specialty pleaded.

walks of the City‘require—in order to put them in a proper and efficient state of re- pair—that a considerable outlay of money should be appropriated for that purpose: and whereas, for the accomplishment of these necessary and desirable objects, the present revenue of :the city is altogether inadequate. For remedy where-of : Be it enacted. by the Lieutenant Governor, Council and Assembly, as follows: I. 'lhe City Council of theCity of Charlotte- town, may, by a By-law duly, enacted and as- sented to,levy an assessment upon the real, freehold or leasehold estate in the, said city, which assessment shall not excee’dthree-pence in the pound upon the rentalyof such real, tree-

hold or leasehotd"estate, according to the valua- tion of the same in the Books of the Assessors, which said Assessment shall be in addition to and over and above. the sum of; one shilling in the pound upon the rental as now levied upon and paid by the occupants of real estatein the said city, and said'~‘assessments shall be duly paid by the respective proprietors or occupants after: due notice thereof; subject, however, to be appealed from in the way and manner pre- scribed in the Act of Incorporation, and the By-laws of the said city. Provided always, nevertheless, and it‘is hereby expressly enacted, that the amount tobe raised under the assess- ment authorised to be imposed by this Act, shall be applied to maeadamizing the streets and roads and constructin sidewalks in the streets and roads in the city. a

II. The City Council may, by a by—law, or bylaws, duly passed andrapprev'ed of, fix the amount of license duty to be paid by shep- keepers or retailers, tavernrkeepers, hotel and boarding and lodging-house keepers, proprie- tors of public saloons, or other places of enter- tainment within the city, for the sale of spirit- uous or distilled liquors in .less quantities than gallons, as well as for the sale of ale,

forms any‘part of the ingredients, and in such by-law, or by-laws, to prescribe the mode of ap- plying for such licenses, and the rules and re- gulations under' which the places so licensed. are to be kept, and prese‘ribe‘penalti'es for the infraction of such rules and regulations, and the mode of. recovering such penalties.

III. The City Council shall have power to inflict penaltiesnot; exceeding ten pounds, for the sale of liquors, as aforesaid, by perSons not licensed. ‘

IV. The different Acts of the Legislature of this Island regulating the sale by‘license of spirituOus liquors, are—so far as the City of Charlottetowd is affected by them—hereby re- pealed from the time when such by—law or by- laws shall have been passed, assented to and published. ‘
