of this egreement. Bat still the books of the Bark are not yet reached; ‘“ the conseat of the Board of Directors” is ‘not obtained and access ‘o the books, there- fore, remain s‘ill-barred. That the con- sent of the Directors was what My. Lawson sought from the first and tironghout his correspondence on this subject, is evident from the foregoing letters. In this shape the matter was submitted to Presbytery, when it sanc- tioned the arrangement above reterred to between Messrs. Lawson and Stewart. In this shape the Presbytery tcok hold of it, ard in this shape they acted on it when they ordered the telegrani to be sent o Mr. Stavert. Did they gain the cousent of the Directors? They did not? Why? Will the Patriot say they did not act rightly in the matter? One thing is clear. Mr. Lawson cannot be held res- ponsible for this failure. He did all that was possible to de, and mere than he had any right to do, to gain this consent. The Presbytery’s telegram, to say ‘he least, is not explicit on the one point of importance, the consent of the Direc- tors. The telegram does not state that Mr. Stewart lifted that responsibility off their shoulders, which, in a very empba- tic and direct way, he had placed there. It says nothing like this. The word Directors is vot found in the Presby- tery’s telegram! “Mr. Stavert’s eye at once lights upon a difficulty. The. tele- |gram states that Mr. Stewart requested 'Mr. S‘.vert’s presence befote Presby- tery ; but this was not granting “permis- sion” to the Directors, whose officer Mr. Stavert is, and therefore his lips remain closed on the point stipulated for by Mr. Lawgon, and, consequently, he concludes his presence before Presbytery was “useless.” He did not appear before it. In view of these facts we vow must with- draw our admission, formerly made, to the truth of the Pairiet’s statement, to the effect that Mr. Stewart gave permis- sion tothe Directors and that that per- mission was telegraphed to Mr. Stavert. The telegram speaks for itself, aad shows that the Patriot can make history to suit exizencies. We had not seen the telegram when we made the admission.

What happened in Presbyiery on _re- ceipt of Mr. Stavert’s response to its telegram, we give in Mr. Lawson’s owa words. He protested against Mr. Stewart getting any more favors before the Court, as the conditions procuring them had not been fulfilled. But ihe Presbytery refused to graat a_ re- quest that seemed most reasonable, After the first part of his trial was over,

But if legally free, they must have Mr. Stewart’s wrillen permission, and then they would readily gravt all the evidence in pessession of their Bank.” This, ia- formation was commuvicated to Mr. Stewart (brough David Lawson, Esq., in

the books fo. warded for the second part of the trial. But Mr. Stewert absolutely and scorufully refused to comply with the request to give his writtea permission. At the second part of the trial, Mr. Lawson assures us that he reported this state of things to the Presbytery, and asked Presbytery to enjoin on Mr. Stewart to give written permission. But they re- fused to. ask him todo so. Nor would they withdraw from Mr. Stewart the privileges which had been granted to him on sup- position that the conseut of the Directors would be obtained througu Mr, Stewart's permission, though urged to do so by Mr. Lewson. And although Mr. Lawson says that he protested, and appealed to the Synod against such action, it seems that in the accidents which accompany trouble- some times there is no record of this appeal in the proper quarter. So Mr. Lawson ioforms us. But wholly inde- peadent of Mr. Lawson's statement in the matter, the autheutic documeats above giveu fully establish the fact that, the Directors to this day are not relieved of their respousibility by Mr. Stewart. Whose fault this is we have vot said. But we have said, and now repeat it, Mr. Lawsou is not tc bame. We leave the ma/ier in tae hands of a discerning and
