the object being to protect day laborers and servants from being deprived of their daily bread,and pot to protect salaried oflicers and ofiicials, whose pay for one month might excced the year’s wages or earnings of an ordinary workman. ‘The decision of Gor- don against Jennings, refrred to in your article, shows that the framers of the Is- land Act used proper language to carry their intention into effect. The Court in that case said that the term ‘* wages” must be applied to money earned by domestic serrvants, laborers, and per- sons of a similar description, and that it seemed obvious from the terms

This English decision has been followed in England ever since it was rendered, and its soundness has never been questioned ; and Judge Alley in deciding the way he did very properly tollowed the judgment of the Court of Queen’s Bench in England, a court composed of fifteen judges whose abilities as lawyers cannot be called in question. I think, therefore, that your reflection on the framers of the Is!and statute is unwarranted. It is quite true that Judge Alley’s decision has been re- versed by a Court of appeal which, how- ever, is not the final Court of appeal in Canada; aud it is not outside the bounds of | possibility to say that the Supreme Court of Canada may have oecasion to deliver a jadgment which will in effect aftirm the |

judgment of the County Court and incilenta'ly reverse the Supreme Court one. At pr s-nt this last decision

would seem to be at direct variance with the Yor sta‘e that no reasons were given by the Island judges for their conclusion. i think that this is a pity. It certainly would have been more satisfactory to the parties to have heard the grounds of decision, and ae a precedent it is utterly valueless. Judges on appeal should give the process of reasoning by which their minds reach that degree of certainty which is always necessary before a court of appeal is justified in reversing, otherwise their decisions weu'd afford no light for future guidance. What practical use would the Supreme Court of Caoada be tothe Provincial Courte if the Chief Justice simply announced at the deliv- ery of judgment that “‘We have considered this case and the arguments advanced as well as the authorities quoted, and are of opinion thali the appeel is well founded ia law and must be allowed with costs,”
