S1-IEDIAC. N. 13.. Nov. 17- (CP)-A judgment which could affect, the entire Northumberland Strait lobster fishing industry has been handed down here by W. F. Lane. magistrate for W651- morland and Albert Counties.

The case was that of Aly:-e Goguen of Scoudouc, charged with retaining lobsters measuring less than seven inches from head to tail. He was acquitted.

The grounds upon which the acquittal of Gogucn was granted are that the regulation forbid- ding the retention of small lob- sters applies only to fishermen.

Goguen was found. in com- pany with Leo L4.-Bianc of Scou- douc. padding ,, lobsters smaller than the legal size which he had bought from a fisherman in Shediac.

John T. Carveli. appearing for the defendant. argued that the words pertaining to the charge under section 8 of the Fisheries Act applied to fishermen only.

The case was tried Nov. 2 in Shediac. and in his judgment. Magistrate Lane upheld Mr. Carvcll's argument, acqultting the defendant. The case 388111-'1 his companion was dropped by the Fisheries Department, and the information withdrawn.

George T. Mltton, K.C.. rep- resenting the Fisheries Depart- ment. will recommend that the department appeal the case. in order to get a ruling from :1 higher court on the matter.

is Arraigned On Charge Of Manslaughter

Mrs. William Bartle. 38. of Al- berton, was arraigned before Mag- istrate R. S. Hinton, K.C.. in Sum- merside yesterday on I charge of manslaughter and after two wit- nesses were heard the court or- dered her remanded in the care of the superintendent of Falcon- wood Hospital for observation till December 5.

This charge is the sequel to a fire that occurred at the Bartle home on October 26, the result of which was the death of her four months old baby daughter, Eliza- beth Ann. from burns. A coron- er's jury on Tuesday night decid- ed that ihe child's death was due to the careless lighting of paper at the foot of her carriage.

Two witnesses were heard yes- terday. Dr. L. G. Dewar and Cpl. M. Hagan. R.C.M.P.. who testified in regard to the mental condition of the accused. Dr. Dewar said that from his observation the oc- cused showed signs of being over tired. slowed up mentally and in a negative way her behavior was somewhat bizarre. He suggested that psychiatric observation would be helpful.

Cpl. Hagan said that after the babyls death he had talked to the accused and she showed lack of grief and any emotional re- action at all.

Nehru assured members of Far- liament, some of whom had ex- pressed concern over defence ar- rangements. that the need for an efficient army would not be sacri- ficed in a drive for economy.

Sioux was battered by the worst gale in her sea career in the China see. last week and came into this naval base with port side guard rails twisted out of shape. steel lad- ders bent and watertight doors warped out of shape. There were no casualties.
