PROPERTY or SToncA-A Mr. John Malcott, in a letter to a morning paper respecting stone for public buildings, mentions a property which we do not remember to have seen mentioned before, viz: ,“ that all stone made use of in the immediate neighbourhood of its own quarries, is more likely to endure that atmosphere than if it he removed therefrom, though only thirty or forty miles."

A TRANSPARENT WATCir.--A Watch has been presented to the Academy of Sciences at Paris, principally formed of rock crystal. The inter- nal works are visible; the two teethed wheels which carry the bands are rock crystal; the other wheels are metal. to prevent accidents from the breaking of the springs. All the screws are fixed in crystal, and all the axes turn on rubies. The escapement is of sapphire, the balance-wheel of rock crystal, and its springs of gold. The regularity of this watch, as a time- keeper, is attributed, by the maker, to the feeble expansion of the rock crystal on the balance- wheel. ~

BURNS THE Poem—We look upon‘ any neg-. loci of this great poet as an impeachment of the public judgment and taste. Bum; in our opini- on, has not yet attained the eminence to which he is entitled. His character, also, we think, has been mistaken, and his acquirements over- looked. He is ranked with uneducated poets, in spite of the' clear evidence of cultivation and knowledge in his letters. Burns was well ac- quainted with the classic models, both modern and ancient. What difference does it make whether education has been obtained from a pub- lic tutor, in a college—a private tutor, in a man- sion—or in a cottage, from the most affectionate of all tutors, self’! The universities can boast ofa Milton and a Newton, but the cottage and the workshop have produced a Burns and a Watt. Burns had at his command every tone, from tra- gic pathos to “ heart-easing mirth ;” every style from the most grave to the most gay ; eloquence and imagination varied and exhaustless ; had he produced a poem worthy of his genius, in sub- ject, character and magnitude, he would be the Ariosto of England—London Paper. 1%. The Courier with the Mails arrived last night'at the Post Office, at Twelve o’clock. The English December Packet had not arrived at Halifax on the 7th inst. English dates, however, to the 10th December, have been received at St: John, N. B., by the arrival there ofthe Ronun'r Bnucn, in the extraordinary short passage ofl7’ days from Liver- pool. MARRIAGE or THE Qantas—The “Special message" to the Privy Council proved to be, as expected, an announcement of Her Majesty's approaching marriage. It was published on the 23d of November, as follows :—

“ I have caused you to be summoned nt’the present time, in order that I may acquaint you with my resolu- tion in a matter which deeply concerns the welfare of my people, and the happiness of my future life.

“ It is iriy intention to ally myselfin marriage with Prince Albert ofSuxe Coburg and Gothn. ‘

“ Deeply impressed with the solemnity ofthe engage- ment which I am about torcontrnct, I have not come to this decision without mature consideration, nor without feeling 'a strong assurance, that with the blessing of Almighty God, it will at once secure my domestic felicity and~serve the interests of my country.

“I have thought fit to make this resolution known to you at the earliest period, in order that you may be fully apprised of a matter so highly important to me‘nnd my kingdom, and which I persuade myself will be most acceptable to all my loving subjects."

It is stated that Prince Albert will return about the middle of March, that he will have the title of Duke cori- fcrred upon him, will be presented with a baton us Field Marshal, and the Lieut. Colonels-y ofthe 11th Dragoons. which are to be made bussars about the same time, until a more crack regiment is vacant.

It is arranged that the Duchess of Kent will take up her residence at Kensington Palace, immediately after the celebration ofthe Queen‘s nuptials, if not before.

April is said to be the month fixed on for the Queen's marriage.

We are able to state that Parliament will assemble for the dispatch ofbnsiness on Thursday thelfitb January.

-The Hilaryi‘Term of this Court for Queen's County opened on nesday last. _The Chief Justice, in the course ofan able charge to the Grand Jury, afler advert? ing in general terms to the nature and importance of the duties which devolved upon them as. Grand Jurors, proceeded to refer to the several cases which would be brought before them. He particularly adverted to the case ofDaniel Macleod, of French River, New London, against whom an indictment would be referred for a Violent assault on the Under Sheriff, wlii e in the act of executin It warrant against his father, in July last. His Lor ship remarked that this was one of aclassof cases, and one, he feiired, of an aggravated nature, which had but mention been brought before this Court, arising out ofthe undue withholding of the payment of rent. The repeated warning given these ignorant and deluded people, the lenient and mitigated punishments which had iitherto been awarded by the Court—even the anxious and reiterated efforts of the Executive Government itself, to dispel their delusion, and induce

had hitherto failed in producing the desired effect. The timeseems now to have arrived, when the majesty of the law must be upheld with vigour, and the notion that brutal force can bear down the arm of the law must be dispelled. \Vere the doctrine once admitted that “ might becomes right," there would be an end to social order, the weak must give way to the strong. and savage force would rule triumphant. The power of the law must be the highest power known; it would be supported by public opinion, and in the last emergency by all the physical strength and force which the Go- vernment could put forth.

His Lordship also stated, that in all likelihood an indictment would also be preferred against Hugh Mac- leod,jun. the father of the person above alluded to, and others, for resistance olfered to the execution of the writ of Fieri Fat-ills, which resistance led to the issuing ofthe warrant which had been referred to.

The first trial which came on was the case of the Earl ofSelkirk v. Macneil, for an arrear of rent. This case created a considerable degree ofinterest. in consequence ofthe question ofllic right ofthe occupyingtenant to the Fishery Reserves being mixed up with it. The Attorney and Solicitor Generals appeared for the Plaintiff, and Mr. Young and Mr. Binns for the defendant.‘ It would appear that the defendant, who had been for several years n tenant on Lord Selkirk‘s estate. had been in the habit ofpaying liis rent pretty punctually for several years, but had fallen into arrear to the amount of£29, or there- iibouts. To recover this amount, the action was brought. Several objections were taken to the accuracy of the nccnunt rendered, and the defendant also set up a plea, that as the land he had taken\waa on the sea coast, and the grant of the Township from the Crown contained the following stipulation:

“ And further saving and reservin , for the disposal of His Ma- jcstv,hr‘a heirs“ successors,5 feet from highwater mark, on the coastnf the tract of land hereby granted, to erect stages

'and other necessary buildings for carrying on the Fishery,”

—that therefoi‘e he was entitled to an abatement of 7s. stg. per nnnum‘ on his rent, for the whole period during which be had.occupied his land, for the 500 feet thereof fronting on the coast, the same never having been grant- ed by the Crown, but reserved for the purposes ofthe fishery. ' ' I Mr. Douse‘, Lord Selkirk‘s agent, was the only-Wit- ness called by either party, who testified as to the accu- racy ofthe general account. A mass of documentary evidence was produced, all of which having been gone through, the Jury were addressed by Mr. Young on be- lialfoftho defendant, who was replied to by the SOllCl- tor General on -behalfof the plaintiff. _ ~The ChiefJustico, in allusion to the disputed items in the account—to rove which Mr. Douse had been culled—remarked, that as he was a witness called by both parties the jury would have .no difiipultyun dis- posing of them, provided they believed _his evidence, the credibility due to which it was their provmceuo judge of. As to the plea which had been_raised With reference to the Fishery reservation contained in the original grant of the Township, he did not constder that at all a question as between landlord and tenant. The ten- ant had no right to call in question the title of his landlord, under whom he held occupation, and from whom he had accepted a loose. Here he proceeded to lay down the law at some length, as between landlord and tenant. IA case might .ossibly occur in which the landlord plight be evicted from his property; or another personmig'ht suc- ceed in establishing a superior claim to rl—in either of which cases the tenant would bejustified in Withholding the payment of rent from his first landlord, because he would have to pay it to another—but so long as he re- mained in the undisturbed possession ofthe land he had leased, he could not legally cull in ucstion‘the‘title of his landlord, whose right he had in no first instance re- cognised, by accepting a lease under him. Upder those circumstances, and ifthey believed Mr. Douse s testimo- n as to the items ofthe account, he thought they could not help finding for the plaintiff. The Jury then With- drew, and after a short consultation, returped into the Court, finding a verdiclt in favour ofthe plaintiff for the amount of his c aim. .
