In Re Daniel Carey's application for regis- tration :

There are fourteen sittings of the Court of Revision in this county, the first of which was held at Belle Creek on the 18th June last, and the last sitting is held in Char- lottetown. Under the Registration Act of 1877 and the act passed last session amend- ing that act the sittings of the County Court for the purpose of revising the voters’ list constitute one term of the court in the three counties respectively. These courts com- mence in each county simultaneously on the third Tuesday in June in every year —(see 5th section Act 1878)—and at each of the places appointed for holding the court in each county the judge is empowered to revise the list of voters for his entire county. The jurisdiction of the County Judge must therefore be in all respects the same in each of these places in determining the right of parties claiming to have their votes regis- tered under the act, and the qualification upon which that right rests must be vested in the voter at the opening of the Court of Revision at its first sitting in each county. The subsequent sittings are in fact ad- journments or continuations of the court held at different places for the convenience of electors and they all constitute but one court. If a qualification could be acquired by payment of poll tax after the opening of the court and before the last sitting was held the statute would confer the franchise on a voter who registered in Charlottetown of which he would be deprived if he at- tempted to register or prove his right to vote at Belle Creek. The practical result would be to make the proceedings of all sittings of the court held antecedent to that in Charlottetown simply nullities in so far as they affected poll tax voters, or in fact any others; for any such voter whose vote was rejected at any of these sittings might reappear at Charlottetown and, by paying his poll tax immediately before or during the sitting of the Court the court there, secure to himself the right to register after his application had already been heard and disposed of by the court. As it is competent for any voter in the county, without regard to his place of residence, to register his vote at any of the circuits appointed for holding the court the qualification to vote and the right to register must necessarily be uniform in all those places, and must be vested in the voter at the opening of the Court of Revision. The investment in the Judge, at each sitting of the Court, with the power of registering votes throughout the County, in itself establishes the conclu- sion, but the provisions of the Registration Act and Act amending it, and the Act amending the Election Law passed last session, appear to me to put it beyond the reach of reasonable doubt. Under the 15th section of the Registration Act, the lists of voters are made subject to revision on the following ground (amongst others) namely,that the names of persons are inserted in them or either of them who are not entitled to vote. The 19th and 20th sections prescribe the course of procedure in cases of this nature. The name of any per- son appearing on the lists may be struck off at the instance of any voter at any of the Courts, if such person does not possess the qualification required by law, and the right to challenge any such vote may be exercised at any of the sittings of the Court in the County. It would clearly be com- petent for a voter, at the first sitting, to ob- ject to the name of any person appearing on the lists on the ground of non-payment of taxes, and the Judge would be bound, on proof of this fact, to strike the name off the lists. If a voter can qualify himself for registration by payment of taxes after the first sitting of the Court, he would equally be entitled, when his name was thus struck off the lists, to have it restored by afterwards paying the taxes; and the provisions of the law in this respect would thus be rendered absolutely of no effect. The 16th section of the same Act directs that certified copies of the Assessment Rolls of each Electoral District fer the preceding year shall, before the opening of the Court, be furnished to the Judge, showing the names of those who have paid the poll-tax or property-tax for such year, and no name shall be entered upon the lists, or any of them revised by the Judge, or allowed to remain upon any lists revised by him, unless the fact that the taxes of such person for which he was assessed and liable to pay for the year immediately preceding such re- vision shall have beer paid, and shall appear to have been paid either by the certified copy of the Assessment Rolls forwarded by the Provincial Secretary, or by other satis- factory evidence, it being th: intention of this Act that no name shall appear on the revised and certified lists of electors except- ing those who, being lega'ly qualified to vote, have paid their poll-tax, or have paid the taxes upon such property as they claim the right to vote upon. of the Court, can only embrace the names of those who have paid their taxes before the first sitting ; and any other evidence of payment of assessment can give the voter no greater right than he could derive if his name appeared on the roll as having paid his taxes. If a voter could pay his tax after the opening of the Court, and secure registration by reason of such payment, the Legislature could have no object in furnish- ing the Assessment Roll as evidence of pay- ment. It would, in fact, really afford only partial evidence of the names of those a paid their taxes, and would practically be useless for the p

for which the law requires it to be furnished. To entitle a man to be registered on the poll- tax qualification, under the Act in amend- ment of the Election Law passed last session, he must be a British subject, 21 years of age, and resident in the polling division where he claims to vote, 12 months before the first day of the sitting of the Court at which he may apply to be registered, and must have paid his poll-tax for the year im- mediately preceding such sitting of the Court of Revision. The payment of his poll-tax rests upon the same footing as an element of his qualification as his nationality or age. Now I think that it can scarcely be contended that a man could qualify himself to be registered by naturalization, or by reaching theage of man- hood after the opening of the Court, and if he cannot, he can no more do so by pay- ment of his poll-tax afterwards. This Act is made by express enactment, part of the Registration Act, and its last section is declaratory of the meaning of this Statute and of the Registration Act with regard to this point. It expressly defines the words the first day of the sitting of the Court for the revision of the list of voters, to mean the first day of the sitting of the said Court at the first Circuit thereof, which may be held in each County for the purpose of such revision. While this definition has especial reference to the uso of the words where they occur in this Statute, it must be applied to the Registration Act, where such application is necessary for the pu

of assisting in its construction, as pas Statutes are in pari materia, and are ire corporated together by express enactment. For the reasons J have stated, I think that no man is entitled to registration at this sitting as a voter on poll-tax qualification who has not paid his poll-tax before the opening of the Court of Revision in Queen’s County on the 18th June last, and I there- fore reject the vote of Daniel Carey.

Great Heat.

The temperature, as registered at the Leeds Philosophical Hall on the 28th, was probably, says the Mercwry, the hi which has ever been recorded there in June, and the average of the last four days isnot likely to be exceeded during the summer. On Monday the maximum was 103 deg., on Tuesday 96 deg., on Wednesday 106 deg., and yesterday 107 deg. The mini- mum on these days was respectively 83, 81, 89, and 90 deg. The corresponding regis- ter for the preceding week gave the maxi- mum at 66, 68,66, 83 deg., and the mini- mum at 48, 49, 48, 46. Unusual, and, we believe, unprecedented, as the temperature has been in this part of Yorkshire, it has been considerably exceeded in the Midland Counties and in the south, and the maxi- mum temperature recorded at the Kew Ob- servatory on Wednesday was 146.3 deg.
