Custom vs. Law.
Sin,—In your issue of tue 15th inst., | notice that a Souris West correspondent wishes to know whether a half dosen Souris rumsellers are going to be allowed to continue to defy law and order, I confess that [ amalittle surprised that anyone should ask such a question; for has not our venerable Chief Justice decided in the Muttart-MelIntyre case that cvstom is stronger than law, or in other words, where treating is the custom of the country, treating ig not contrary to Statute? it fol lows, therefore, that where rumeelling is the custom of the country, rumselling is not contrary to law. This, perhaps, is good law. If so, it is easy to legalize any con- duct that happens to be of such frequent occurrence as to become a custom,
There are judges who widely differ from this ruling; for instance Chief Justice Spragge in the West Simcoe case. recently tried in the Ontario Courts. It would appear, however, that the public mind—apart altogether from the conflict- ing ruling of Judges—is somewhat mixed on this subject of law and custom. ‘Lhe schooner Bismarck, Maskell, master, from Montague, P EL., via Jeddore, reports that on Thursday, Dec. 6th, about 4p. m., when near the Western Shag ledge, off Sheet Harbor, she noticed four men on another ledge, about a quarter of a mile nearer shore, whom they rescued and brought to port. They proved to be Captain Martin and the crew of the sebooner Lady Sarah, of and-from Port Medway for Arichat with a load of lamber. The Lady Sarah had been into Jeddore and was proceeding that morning, when a sqvall struck and capsized her. All han‘s got into the boat, but she was partly smashed on the deck load when launching, and they barely managed to reach the edge they were found on. The boat went adrift and broke up, and the vessel was Jast seen bottom up, grit d ng against another ledge, {One trunk wie all that wes saved. It was vory fortunate that the Bismarck happened along before dusk and acted the part of the good Samaritiap, as, although the ledge afforded room ‘enough for accommodation on a fine day in fair weather, a heavy sea would wash over it, and the en- suing night to that of the rescue was so cold that the men there would probably have perished, ‘They were on)y on the ledge, how- ever, gome three hours. The Lady Sarah was 22 tons register, built at New Dublin in 1848, hailed from Liverpool and owned in Port Med- way by ber captam. There was no insurance on her.—sSt. John Telegraph,
