MATTER of an application of JAMES DESBRISAY for leave to issue Execution against the Lands of RICHARD BARRY, late of St. Peter‘s, in King’s County, in the said Island, deceased; on a judgment formerly entered of Record in t’he‘said Court, wherein the said James Deslirisay was plaintiff and the said Richard Barry wasdefendant.
WHEREAS application hath been'made to thisiCo'urt, on the part of the above named James DesBr‘isny, stating’ that the sum of Thirty Pounds. Seventeen Shillings, with interest thereon, is due to him on. and secured by, a' certain judgment of Reecrd. at ‘his suit against the said late Richard Barry, now deceased: entered in or about Easter Term. in‘ the year of Our Lord One Thousand Eight Hundred and Sixty-three, for the'sum of Sixty-one Pounds, debt, and Three Pounds, costs of suit, and execution on said jud’gs ment hath been moved for on behalf of the said James DesBriehy :
It is ordered, that, unless all or some of the persons interested in the lands formerly belonging to the said Richard Barry. deceased, shall, on the Twenty-fifth day of JUNE next coining, being the’first day of nextTrinity‘ term of this Court, at Charlottetown, for Queen’s County, come forward and show cause why Execution should not he issued upon the said’judgment, at the ‘suit of the said James DesBrisay, against such lands of the said Richard Barry, deceased, or his former right, title, and interest therein, then Ex‘ecution‘will he issued against such lands and the teneineuts'and hereditument‘sof the said Richard Barry, deceased, in pursuance of the A‘ctot‘v the General Assembly of Prince Edward Island, passed in the Twenty- fourth year of the Reign of Her present Majesty. intituled “ An Act in amendmentof and'addition to’lhe'Aets relating to judgments en- tered of Reem'd‘in the Supreme Court’ot'Jindicatore."
