The judge, Harry J. Lemley, had said in effect that the pres- ence of troops in Central High School-they were put lhere at President Eisenhower's order to protect the nine Negroes — had produced a tense atmosphere that made teaching difficult.

The St. Louis Appeal Court didn‘t think this was, the point. The majority opinion said:

"The issue plainly comes down to the question of whether overt public resistance, including mob protest. constitutes sufficient cause to nullify an order of the federal court directing . . . in- tegration.”
