On these grounds the present Govern- ment of this Provines felt satisfied that it vas no part of their duty to construct and naintain any of the public wharves of this Island. ne Government acted in accord with a certain resolution lately passed by the Legislative Council, to the effect that we should have affirmed the right of this Province to the value of all piers or wharves constructed prior to and existing at the time of Cun- federation, they would have thruwn away the whele case. For if the property in the wharves did not pass to the Dominion at the time of Confederation, we bave no claini at all; and itisenly upon the assumption thatthe Dominion Goverament Were bound to maintain its piers, that the Province has any claim whatever t> an indemnity. The resclution passed by the Council is so absurd as to be positively asteuunding ; and it is direct opposition to the interests of the Pro- vines. In 1881, the attention of the Gov- ernment wescailed to the case of Holman vw. Green, which wes then progressing in che Supreme Court of Canada. ‘The Gov- ernment were asked whether or not they would intervene in the case. After some consideration the Government decided not to intervene ; for had they done so their contention must have been against the in- terests of the Province, in upholding the grant to the plaint:ff in the suit, and besides they felt sure that without such imterven- tion the result would be favorable to the Island. The jndgment, as anticipated, strengthened our claim npon the Dominion Government. Chief Justice Ritchie, after quoting the 6. N. A. Act in his judg- ment, said that;

‘*The properly in public harbora beiny thus vested in the Dominion, the svil un- granted at the time of Confederation be- tween high and !ow water marks, and being within the limits of publie harbors, by the express unqualttied words of the enactment, became vested in the D. minion as part and parcel of the harbors, which belonged as proper'y to the Province.”

The Chief Justice also said that :-—

‘The cxclusive legis'ative an‘hority over the regulation of trade aud commerce

And referring to the clause in the Britich North American Act, before quoted, His Lordship said :—

Mr. Camppeci said that he had received the petition and had sent it with others to the Gierk of the Exrentive Council. had, in the nr eantime, been no meeting of the Council, and it had not, therefore, been brought tothe notice of the Government. As soon as there is a meeting. the prayer of the petition will be considered.

The fair inference is there- fore that it was intended to transfer the harbors in the widest eense of the word, including a!l proprietary as well ae preroga- tive rights to the Crown as representing the Dominion.’

These are the opinions of one of the most di-tingnighed Jurists in Canada. Then Mr. GGWY¥nne says :—-

‘Her Majesty remained seized of those harbors and of the land covered with the water thereof, jure regio for the public pur- poses of the Dominion and subject to the exclusive control of the Parliament of Canada.”

These judgments as before remarked very materially furthered the claim of the Island —in fact settled the question, in which it was involved beyond dispute.

Attention might here be called to the expression ‘‘Public Harbor.” Strange asi' way appear there are private harbors, as dis‘inguished from *‘publie harbors.” Even se impertant a harbor as the harbor of S-. John, N. B. is a private harbor, having been granted by the Crown in the year 1785 to the Corporation of the City of St. John. Last year it was vested in Harbor Com missiovers appointed by the Corporaiion, the Board of Teade and the Dominion Government ; and the Dominion Govern- ment granted $500 000 for the purchase of the Corporate rights of the City, and the construction of whsrves and appliances necessary to the trade of the ports The harbor of Montreal also is a pri- vate harbor; so is that of Quebec; of Sydney, Cape Breton; of Pictou, Nova Scotia; and many others But there are no private harbors on this Island, and we fz]: satistied that legally and equitably we had the right to ask the Dominion Government to make good our claim. But we fortified ourselves stil! further. The terms state that, in respect to harbors, ete., the Island shall be treated as the other Provinces ; and on looking inte the public accounts, and the blue books, we find that the Dominion

Yovernment have been constructing and maintaining just such public works as the | piers of P. E. Island. At Fort Darlington Oshawa, Whitby, Coburg, River Blanche. and many other plices throughout the D - minion, the Dominien Government have, year afier vear, made large expenditures on works precisely similar to our piers;—and these tacts also gave streugth to our case.
