THE LIBEL CASS, The caso of Wilham McGill, Esqr., vs. the Praprictor of the Jsland-r, was tried before a special Jury on Wednesday | last. This was an action for an outrageous and unprovoked | libel, published against the plaintiff shortly after his appoint | ment to the office of High Sheriff in the spring of last year. | The defendant charged Mr. McGill with fraud in his private | capacity as a merchant, without the shadow of foundation, | and attempted toshow thereby that the Goyerrmenit did. wrong | in appointing lim to the office of Sheriff. Unable to justify” the charge, the defendant's counsel pleaded the general issue, | and reste! his defence on the silly plea, that in assailing Mr. MeGill’s private character, it was not the intention of

the Jslancér to do him an injury, but to censure the Govern-

ment for appointing him. ‘This was an extraordinary ground of defence, and if tenable, would lead to the most dangerous results. According to the argument adduced by the learned

counsel, any public journalist may invent and circulate what

falsehceds he pleases against the private character of an official

—may assert that he is a bankrupt and a swindler, « thicf, a

murderer, or any thing else; and if brought to account for his libellous attacks, may demurely say that be did not intend | to injure the party assailed, but to redvessa public wrong. On the Jury there were eleven persons politically opposed to the) plaintiff, and only one whose principles were in harmony with | bis own. Our readers will not be surprised, therefore, to | learn that no verdict was agreed to—the Jury were discharged ; | wad the ease stands over for further investigation.
