This made pessible the rapid sof assault. It was in the engage- nent near Mo Tien Ling on the 25th that the Kurin troops tried to break the Japan- ese right flank but were repulsed. The amount is claimed by the plaintiff on the ground that he was one of the original beneticiaries of the fund to the extent of $200 a year, but that in 1886, while living at St. John, N. B., he left to go tothe United States for the benefit of hia health. He was away two years, and when he re- turned, he claims that the board refused to put bira on the list. He sues for five years,
