The Court met to-day and delivered judgment ii two cases ' Davis es. Mahoney.—This was an appli- cation te set aside the arrest of the defend- ant, who is a citizen of the United States. The facts were that he came here temporar- ily for the purpose of buying produce tor the American market, and chertered a schooner for trading up and down the river to obtain cargoes. It was claimed by plaintiff that the charter had been broken, and he issued 4 bailable writ against de- fendant for damages. ‘The law relating to arrest forbids any bailable writ being issued except in cases where the defendant is about to quit the Island with the intent ot defrauding the plaintiff. The plaintiff issued the writ, alleging that the defendant, being only here as a.anere temporary trader, and being about to go home to Boston, was of necessity gding away to defraud hit, which would be the result of his going away, as his remedy would then be gone. ‘he defendant's counsel argued that no intent to defrayd could be inferred from the mere fact that he was going home, as he only came here for atemporary purpose, and his going home was in pursuance of his original in- tention, which existed before he came here and before the alleged breach of contract.

The Court (Mr. Justice Peters dissent- ing) held the defendant's point to be well taken, and set aside the writ and dis-
