Councillor Tanton then brought up the matter of the qualification of Councillors Fennell and Haszard, submitting two lengthy documents in connection there- with. In one of the documents he charged that Councilior Haszard did not have the necessary real estate qualifiva- tion to entitle him to a seat at the Board, and asked the Mayor to call anelection to fill the vacancy created by reason of this lack of qualification. In the other docu- ment he charged that Councillor Fennel! had also become disqualified by reason of the firm of which he was a member hav- ing sold goods to men employed by the city to do work on the market building.
Councillor Fennell declared that he made no arrangement with the persons re- ferred to asto where they should purchase the paints or hardware used in the work on the market house. He did not know thatany materials bought at

Councillor Taylor claimed that Couneil- lor Fennell knew very well that the things referred to by Councillor Tanton in his documents were got at his store. If it was right for Councillor Fennel to sell to the city he (Councillor Taylor) claimed an equal right.
Councilior Tanton then moved the fol- ing resolution which was seconded by Coun- cillor Taylor:
Resolved that His Worship the Mayor do consult with competent disinterested counsel relative to the qualification and standing of Councillors Haszard and Fen- nell as representatives at this Council Board and that he take such actien io the matter as said counsel may direct.
Councillor Haszard said he felt easy on the matter of his qualification. It was all right. He qualified on undivided inheri- tance. The Court and not the Council was the proper place to settle the matter.
Councillor Fennel then pointed out that although Councillor Tanton haa taken the property qualification oath he did not seem to be qualified. According to law he must have $1000 worth of real estate free from encumbrance and the assessment roll showed that his real estate was only yalu- ed at $850. ;
Councillor Tanton advised Fennel to ask for an investigation if he was in doubt. °
Councillor Douse thought it would be better for all conceraed if the whole matter were fully investigated.
Councillor Haszard was opposed to pay- ing for outside counsel when they had a paid Recorder.
Mayor Dawson said he must have proof of the allegations before taking action. If legal proof be given he wonld have no hesitation in following out the course laid down by law, as he had done before. If satisfactory proof were given him that any member of the Board was not properly qualified, he weuld have to do his daty and issue the writ fora new election. Then if any of the gentlemen affected felt them- selves aggrieved they could take action against him in the courts.
Conneillor Tanten’s amendment was then put and lost, and Councillor Hughes’ motion carried.
The tender of Clarkin Bros. for supply- ing coal to the city was accepted, it being the lowest.
After disposing of some other business of routine character, the Council adjourned sine die.

A timely opening of his eyes saved Albert Smith, a Wheeling drummer, from being buried alive. He was thrown from a train at Messerly, picked up unconscious and pronounced dead. His supposed re- mains were turned over to an undertaker for shipment home. While the under- taker was preparing the corpse, Smith opened his eyes, saw what was going on, and after proving himeelf still alive, was taken home. He will recover.
The new tariff law has not so far proved a successful policy for the United States Treasury. The first month of its operation shows smaller revenues and larger expend- itures than for the same month of 1893. The New York Commercial Bulletin finds these rezuits disappointing, and declares, further, that “the gold receipts’ through the revenues are insignificant, and it is ap- parent that the rsplenishment incidental to the currency movements of the season will be but slight, and no adequate prepar- ation for the renewal ef the drain for ex-
