IX. Every such agreement shall be in the form and shall containtrue entries under their respective heads, of the seve 'al particulars, as set forth in the Schedule to this Act annexed, marked (A), so far as the same can be ascertained; and the owner and master of every such ship, or one of them, shall, on reporting his ship’s arrival at her port or destina- tion in this Island, deposit, or cause to be deposited

with the Controller ofCustoms and Navigation Law's, , at such port, a true copy ofsuch agreement, attested, by the signature of the master, to the intent that= every person who may be interested in any such agreement, may at all times have the means of knotv- ' ing the terms and conditions thereof.

X. If any master of any such ship as aforesaid, shall carry out to sea, any seainaa (apprentices ex—: cepted) Without having first entered into such agree—‘ ment, as is hereby required, he shall for every such offence, forfeit and pay a so a not exceeding live pounds, tor, or in respect of each and every scaman he shall so carry out contrary to this Act; and if any master shall neglect to cause the agreement to be distinctly read over to each of such seamen, as by this Act he is enjoined, he shall for every such no» glect, forfeit and pay the sum oftive pounds; and if any master shall neglect to deposit with the Con- troller of Customs and Navigation Laws, a copy of the agreement hereby required to he made, and de— posited as aforesaid; or who shall \z'iltnlly deposit a

XII. Ifany person receives or takes into his pos- session, or under his control, any moneys, documents r etI'ects of any seaman, or apprentice, to the sea service, and does not return the same, or pay the value thereof when required by such searnan or ap- prentice, subject to such deduction as may be justly due to him from such seaman or illtl'H‘C'ililCC, in re- spcct of board and lodging, or otherwise, or absconds therewith, he shall incur a penalty not exceeding ten pounds; and any two Justices of the Peace, may, besides inflicting such penalty, by summary order, direct the amount or value of such moneys,documents or effects, subject to such deduction as aforesaid, to be forthwith paid to such scaman or apprentice.

XVllI. NO seainan shall by any agreement, ftd‘it‘It his lien upon the ship, or ice deprived of any remedy for the recovery of his wastes, to which he Would otherwise have been entitled; and every stipulation in any agreement in Consistent» with any provision of this Act; and every stipu- lation hy which any seaman Consents to ahttndvan his right: to wages in the case of the loss of the ship, or to abandon any right which he may have or obtain in the Nature Of salvage, shall be wholly inoperative.

XlX. No right to wages shall be dependent on the earn- ing of freight, and every seamen and apprentice who would bc‘entitled to demand and recover any wages of the ship in which he has served, had earned freight, shall, subject: to all other rules of law and conditions applicable to the case be entitled to claim and recover the same, notwithstanding that: freight has not been earned ; but in all Cases of wreck or loss of the ship, proof that he has not exerted himself to
