judgments, may be summarized as follows : | In November, 1893, the defendants hauled | two maple trees for the purpose of making runners to remove a house. They claimed | that these trees were cut on their own land, and showed the stumps of the trees from which they said they had cutthem. The plaintiff, on the other hand, claimed that these trees had been cut on his land, and also showed to witnesses the stumps from which he alleged they had been cut and proiuced parts of them in court. At the first trial the plaintiff proved that the stumps on his land were perfectly sound, al-o that the runners were sound ana that } the stumps on the Powers’ land were un- }soaud. He also proved that the trees | taken from his land had been partly sawed j} and partly chopped, and that the runners | the Powers’ used had been cutin this way. | For these and several other reasons judg- } ment was given in favor of the plaintiff at the first trial. At the second trial, which occupied about four days, a great number | of witnesses were examined. The Powers’ | proved to the satisfaction of the Court that the runners which they used were not | sound, and that they corresponded in this jand other respe ts with the stumps on | their land. Thy al-o proved, by the man | who dressed the runners, that they had } been wholly chopped, and not partly | sawed and partiy chopped, as claimed by the plaintiff. It was also shown that the | stamps on the plaintiff’s land were perfect- ily sound. Other evidence in the defend- | ants’ favor was also adduced, and the pre- | vious judgment was accordingly reversed. | It was on this judgment that the applica- tion for a new trial was made yesterday.

“Buchanan had married the daughter |of an esteemed resident of Brunswick | street, and seeing that he could not suc- cessfully fight the board he agreed to go to | Edinburgh and study, so that he might pass the required examinations. It was | with money received from the kind-heart- ed father-in-law that he and his wife cross fed the Atlantic for Scotland’s capita] | Study there was a farce, but he was in | earaest in drawing on his wife’s father for large sums of money, and having a “good | time,” he got to the end of his tether and icame to New York. When first proposed it was tocost about twelve thousand dollars, and the taxes to be laid on us about six hundred per year.

Now it has increased to about twenty thousand, and from their. calculations it wonld increase our taxes to one thousand per year. The calculations of some ot our best men and councilmen show us that. it would cost from twenty-five to

We are aware of the strong influence pressing the commissioners in this matter, and it is very probable the origin of the proposed second water-pipe--the increase in their salary. Their actions appear to me as if thev were looking after their own interests instead of the public welfare. I deny that we are in need of asecond water- pipe, and would ask anyone to name me a

city that has two large water-pipes, a short distance apart, conveying water from thesame fountain. Ata public meeting, held in the Market Hall

previous to our system of waterworks, The Insurance Companies promised if we should adopt a system of waterworks, that our premiune (they were sure) would be lowered to one-half per cent. How have they fulfilled their promises? They have increased the*percentage, and taken as their excuse, that the fires in other cities have made it necessary to raise on us. We are aware our City Council had contend with strong opposition from those com- panies, and in their resolution on April 25. I feel proud that our confidence has been placed in men worthy to look after the welfare of our city. I thank our worthy Council for their resolution, and
