Boats come io every day or two from up the river with eccres and hundreds of disappointed gold seekers whose stories of ill Juck and hard -hips are vividly told tothe multitude that bas come hereto take passage for the mines, This results in many selling their outfirs and returning to the States. The hotels on the shore are nightly taxed to their ut- most capacity in accommodating guests and almost every craft in the harbor is utilized as atemporary hostelry. News ‘that ne gold has been found on Kotzbue and Norton Sound adds to the discourage- ment of the genera] multitude.

Inthe harbor of St. Michaels are 53 steamers aad sailing vessele, all beavily laden with passengers, general cargo and river boats. Several steamers have large lists of passengers who purchased tickets

direct to Dawson and farther up river points and on arriving learned that ar- rangements had not been made for ther

transportation. The steamers insisted on landing passengers on the beach, thus throwing them On their own resources. St Michael’s is under military jurisdictiod and the commanding oificers refuse to allow such passengers to be -utashore. The result is there are four or five steamers in | port with several hundred passengers whom they are unable to land.

ABANK’S LIABILITY.

The Tradesmen’s National Bank on October 15, 1891, refused to pay on pre sentation a check drawn byWilliam H. Burroughs against his account kept with it. After five days the bank discovered its error,and the check was paid. A suit brought by Borroughs against the hank for damages for ite failure to honor the check was brought totrial in the Suc~ preme Courtin Brooklyn.At th? en dof plaintiff’s case thetria! judge refused to grarta motion to dismiss the compiain’ mad: upon the grourd ,anong others, hat the action was based upou contract ans not upon atort; no charge of wilful or malicious injury being made. The court then directed a verdict for plaintiff for 34 cents, interest upon the cheque fer five days. A jodgement of the late General Term of tue second department affi ming the judgement below has now been affirm- ed by the Court cf Appeals. It was held that the failure of the bank, which had on deposit funds saffisieat for the purpo<e to pay thecheck ofthe depositor, rendered if liable either in tort or upon contract. When, however, the deposicor brought his action for breach of contract, the failure to pay not beingcharged to be wilful, and no special damages being alleged or proved, and the cheque having finally being paid, the plaintitt was not entitled to recover more than nominal damages.—New York
