Tn this opinion your committoe feel themselves confirmed, gsthey find the Act for leasing the Common was repealed in \9, the 49th year of Geo. ILL, forty years ago, a time when the incumbranees were removed, the desired effect of sae act having been accomplished.

Ia searching the records of the Register Office, your committee find, Lieutenant Governor Fanning causing the Common to be laid off into thirty six blocks of land, con- taining twelve acres each, which were granted away on cer- tin conditions, a copy of the grant of one of these Lots, viz., No, 10, is htreunto appended to this report and marked A. We beg to call the attention of the Council to that part of the grant which points out the locality, under the plea of ghich the present incumbents hold possession of the Com- mo. The Grant expressly states it to be a Lot in the foyalty of Charlottetown, there is no mention throughout of any land being granted in the Common, The document

states, the Lt. Governor grants such a piece of land by autho- |;

rity given by His Majesty King George the Third ; it care- fally abstains from any allusion to the Common.

The paper in the Schedule, marked B., has been obtained from the Kegistry Office: its columns show the Grantees’ games, enumerates the time of Registration of the Grants, the Lots remaining ungranted &c., Kc. It appears from this certificate, that the Grantees of Lots Nos. 1, 2, 5, 7, 15, 17, 19, 20, 24 and 30, complied with one of the conditions of the Grants, viz., that of Registration within six months from the date of the Grant, that the following Lots were not re- gistered until after that period, viz., 3, 4,11, 12, 13, 16, 4,27, 31, and 34, failing to perform which condition a for- feiture of the graut was the penalty, that Lots Nos. 6, 8, 9, 10, 18, 21, 23, 26, 28, 29, 32, and 85, have never been re- gistered, and that the dates of Grants of Lots Nos. 10, 18, v3, 20, and 32 remain blank, and also that Lots number 25 and 33 have never been granted.

Your committee have obtained from the Surveyor Gene- ral’s office two plans of the Town and Common, on one of which is laid down the Common as it was previous to its be- ing occupied, the other shows the manner in which the Com- mou has been devided into Pasture Lots as it is now held.

Your committee note on the original plan of the Town and Common, that the Common was reserve! for extending the Town, when circum tances warranted the enlargment, and that the Government furm containing 100 acres, is part thereof, and finally, they conelude their Jabors in the belief, that no authority can be produced to prove a power existed to grant it away, without an act of parliament to that effect. Tis statement they respectfully submit to the Common Council, to deal with as it may deem meet ; recommending its submigsion to the Law authority of the Corporation for bis opinion thereon.

Kyow ye, that I, Edmund Fanning, L. L. D. TO THE EDITOR OF THE EXAMINER.

Sir ;—On reading the report of that humbug mecting which was held on the St. Peter’s Road, I find that my name has been inserted as one of the committee to procure signatures to the memorial for the dissolution of the present House of Assembly. The maniacs who had the audacity to propose me would do much better by attending to their own affairs, than by vindi- cating a measure through vindictiveness : the one for the paltry office of emolument which he lost by his own negligence ; and that officious bum-bailiff would do better to be planting some esculents than advocating a measure which would in no wise benefit the public now more than it has for years past. They must be aware that the agitation of that question, which cost the country so much for fruitless delegations, is only now “a delusion, a mockery and a snare.”’

I will be much o we to the persons who proposed me to find a substitute, as I had no rticipation in the meeting, and have no confidence in those who got it up, nor do I ever intend to countenance so absurd an undertaking.

LOT No. 1.—Those premises situate in Water Street, and known as the ‘* Perrace House,’’? with the Stables attached thereto, measuring 84 by 120 feet. The buildings could easily be turned into three shops, leaving plenty of yard room for warehouses. ;

LOT No. 2.—That Lot ef Land situated in Sidney Street, immediately adjoining the Hon. D. Brenan’s Brick Building, measuring 4) by 80 feet. The building consists of two shops and a dwelling house.
