Two young lads, named Earnest Smith, familiarly known as ‘* Oiney,” and Joseph Dunne—-the former about twelve and the latter about iourteen years of age—were charged with breaking into the store of Mr. D. Small, on Water Street (west), and stealing therefrom a number of articles, | among which were twenty figs of tobacco six boxes fish kk of brass grimets, ete.

Mr. Small testified that between one and two o'clock this morning he was aroused from his slumbers and mformed that bur- | glars were at work in his store. As scon! as possible afterwards he-was on the scene, but the burglars i decamped. An in-| spection of the premises showed that ; entrance had been eifected through a win- dow in the rear of the store, and that the thieves, after going through the place, had

clue to the burglars, and discovered the foot prints of two parties leading from the| store in the direction of Lord’s Wharf. He! followed these footprints and discovered | that they terminated near a stable on the wharf. This stable was on blocks, and he surmised that as the footprints did not lexnd from the stable the thieves were hidden either in it ur under it. He waited about for a while, and when his son and ther men came along they searched nder the stable and there found the youthful burglars. H then took them to the police station, wuere they were searched and their booty was found on them.

His Honor then asked the boys what) they had to say in their defence. They j made no reply, and he sent both up to the Supreme Court for trial.

Alice Smith, the mother of ‘‘Oiney” was next arraigned charged with being a receiver of stolen goods,

Sergeaut Cameron stated that in com- pany with officer Bradley he had this morning visited and searched Mrs. Smith's

dwelling for goods supposed to have been taken from Small’s store. He found the brass grimets on the mantel. He asked Mrs. Smith where she got them and she told him she lad bought them from

streets. The sergeant then told her to tell the truth about the matter as he knew quite well that the I! » did not sell such things. She then told him that ‘* Jmey”’ had found them somewhere and had brought them home. Officer Bradley found the tape in an old box in the corner. The sergeant

looked at it and asked Mrs. Smith how she came by it. She told him that the boy had brought it home on Sunday week and had found it in some yard. He also found a lot of pens and sand-paper. The boy told him he had_ purchased the pens and had been viven the sand-paper. ~~ of

Mr. Small was then re-called and identi- fied the articles shown excepting the pens and sand-paper. He also said that since the arrest he had made the discovery that the thicves had entered the sail loft and store-room as well as the store, and while in the store-rcom had fillen three sacks with lead.

Mrs. Sm‘th took advantage of the privi- lege. accorded her-and@ -delivered a somewhat lengthy address. She said that om last Sunday week the boy had gone with her to church and after church had gone to Sunday schoo!, snd it was while he was away from her to Sunday school that he He told her that he had tound the tape ina yard near the railway where’t:ic Sunday school was. She chided him for taking it and told him to take it back. As for the brass grimets they had been in her house since last June. It was a common thing for the boy to find things in yards and bring them home, although she had often chided him for so doing. She had tried her best to make a good boy of her son, but other boys had led him astray, and she wished he were dead.

His Honor remarise4 that he did not be- lieve one word she had said. She was an abandoned character, and her boy, fora Sunday School atiendant, was an accom-, plished thief. He sent herup to stand trial in the Supreme Court for being a re- ceiver of stolen goods.
