A bill was filed by the complainant to set aside a mortyage made by the plaiutitf in favor of the defendant, wherein the con- sideration is siated to be $800, and which

was duly executed by the plaintiff. After

the mortgege was executed, Good, the . P —> 2°

solicitor, applied to Cameron for the

money, which was paid by him to Good. The plaintiff alleges that the mortgage was iucorrectly read over to bim, the only consideration read by Good was $150.00, Good only paid the plaintiff The balance was appropriated by Good to his own use. The question for consider- ation of the Court is whether Good was the agent of the plaint'if or defendant and whether in any event the, defendant did not pay over the menev to Good at his own risk without having a written authority from plaintitf so to do. Mr. Mathew Smith, of Hampton, while working in the woods, yesterday,was hit on the head by a decayed branch which fell from the top of a nearby tree. The blow tumbled Mr. Smith over and made a nasty cut, but he is nut, we are glad to say, seri- ously hurt,

Mr. Geo. E. Auld arrived home vester- day from Fngland after a very pleasant passage. Mr. Auld when asked about the egg market in the old country said be pre- ferred not to speak just now. He, however, expressed hin:self as greatly pleased with hia visit, and with the courtesy he, as a Cana- dian, met with from everybody. He visited Liverpoo], Manchester, Leeds, Glasgow, Edinburgh and London. He found P. E. Island cheese evjoying & good reputation.
