As they have done. so must we do. Our legislators must do their best to prevent the really unfortunate man from being crushed to the earth; while at the same time they take every possible precaution to dis— courage recklessness. extravagance, and dishonesty.

The principal defects of our law seem to us to be two. The firstis that it pro> vidcs no direct means of forcing a man to go into the Court. \Ve think it but right that the creditors of abiisincss man who have good reason to believe tluit a debtor is either dishonesily or wastcfiilly making away with their property, should have the privilege of calling him to ac< count. and of saving as much as possible out of the wreck of their property.- “'0 do not think that one or twu of the credi- tors should havc this power of forcing a man into the Bankruptcy Court; but. at any time, we are clearly of opinion. that this power should. under salutary rc- sirictions. be invested in those whose pro- perty the debtor may be either wasting. or by dishonest means placing outofthcir reach. An honest man need not be aiZaid ofthc investigatieu of his alfairs. and the safety oftlie creditor might make sueii an investigation absolutely necessary.
