The Scaffold for Buck.

Work has commenced on the scaffuld on which Buck will be hanged. An annex will be built in the rear of the jsil for the purpose. The method of hanging will be by walking beam. to one end of which a large irou weight will be affixed, The other end wil! hold the noose, which will be fix- ed around the doomed man’s ncck. When the end of the beam holding the weight is est loose it will come down and the other end fly up. This is supposed to be an im- provement over the cli method. Buck wes informed yesterday that the Governor- General had considered the petitions and refused to inte:fere, The news did not effect him in the slightest. He was seen shortly afterwards and he talked freely and laughed friquently. He said that he had never yet shown the white feather, and would not do so now,

gave testimony regarding the Coolgreeny estate. The archbishop said that the rents on this estate were above the valuation, while those of the neighboring estate were equal to or below the valuation. He cen- sidered that landlords and tenants were as partoers, It was an anomaly that one of these partners should have power, for a emall default, to turn out the other. Ac- cording to the archb'shop, the scheme for a settlement of the evicted tenants’ question should include the reinstatement of ail of them in their holdings, and all persons holding lands from which the former ten- ants had been evicted ought to be compen- sated when obliged to leave.

LETTERS TO THE EDITOR
The City Court.
Six, -The Judge of the County Court of Queen’s County has apparently taken the
| opportunity of raising a doubt as to the
jurisdiction of the Stipendiary Magistrate in which a merchant citizen scught to enforce hia right to collect a debt admittedly due against a debtor, who, to say the least of him, has earned an unenviable notoriety in the ability he has displayed to evade pay- ment of his debts.
Most laymen will not readily under- stand why the County Court Judge should undertake to give judgment on a point not raised in his court. The point actually at issue before him was, whether under the consolidated city charter, the execution in the cause referred to, should have been is- sued by the Clerk of the Co: rtfor by the M igistrate himself as such Judge. This is a point which the wording of the statute renders doubtful, and the practice of the City Court has, inveriably, been to leave t1e judgment creditor his remedy by ordinary execution, rather than issue for him a doubtful writ, which might subject him to an action for false imprisonment. Whether
the Provincial or Dominion Governments
have the power of appointing the City
Court Judge, might weli have been left ie
an authoritative tribunal; and in justice to the counsel for the defendant, it may be stated that he did not aek or argue for any decision on that point befcre the County Court Judge. The power of the Provincial Government to make such appointments is a grave constitutional question, one that can only be settled befire the Supreme Court, or the highest court of appeal, on argument carefully presented by ¢ unsel, fuliy instructed. NoCounty Court judg ment can possibly effect the question.
I write now, however, to raise another ques- tion of much interest to ci‘izens, namely, whether it 1s at all necessary for the collection of sma} debts in the city to have two courts of almost co-ordinate jurisdiction. The City Court, of the city, with its month'y sittings, provides ample accommodation of a!] parties. The law provides that in all criminal matters the S'ipendiary Mvgistrate shall have sole jarisdjccion in the city. This hae been found to work well, and with full power of appeal direct to the Supreme Cou-t, euitars are not eu! ject to the anomaly of clashing judgments. It is not a particularly edifying spectacle to see a suitor in one court obtain judgment on the confession of the defendant, and by an- other court of «qually inferior jurisdiction be deprived of the venefit of suon jidgment une less he edepts the expensive course of an appeal to the Supr me Court.
